Below the Nightcruiser Booking Crew –  Adelaide has put up the terms and conditions that you will automatically agree to when paying your deposit. They were prepared in simple detail for your benefit as we operate strictly in a law-abiding manner. Be advised that Nightcruiser [Agents] Party Bus Tours use chosen Sub-Contractors [Supplier] for our tours and services, which you [Buyer] acknowledge and agree to. By Paying your Deposit/Security Bond you automatically accept full responsibility and the Terms and Conditions below. This includes our chosen Sub-Contractors’ terms and conditions as added separately below..

1. 
 Responsibility and Representative Services
You must be over 18 years of age to make any booking, alternatively, your Parent or Guardian can make the booking on your behalf.
You and or your Parent or Guardian automatically agree, confirm, and accept full responsibility to the set-out terms and conditions herewith when you pay your booking/security bond to Show World Corporation Pty. Ltd. trading as “Nightcruiser” for and on behalf of any Nightcruiser’s chosen Sub-Contractor carrying out the services.
2. Communication:
Email communication, text, or faxes between our offices and clients are deemed and treated the same as a signed legal contract.
You must receive a confirmation if any requested changes are sent from you via emails or text or consider the changes not been acted upon. Best to phone bookings to be safe.
3.   Booking Deposit:
Must be paid in advance by the due date requested as stated and or attached to our email to protect your date. Payment options are also detailed and attached.
4.   Refund of Deposit:
Non-refundable. We are unable to refund your deposit for a cancellation for whatever reason.
5.  Security Bond:
The bond can be refunded immediately after the Charter after an inspection by the Cruiser Captain for no damage and cleanliness present. It is your responsibility to ask the driver for this refund and it is the driver’s right to withhold this bond after inspection. If you have any dispute it can only be solved by the Sub-Contract Vehicle Owner Operator.
6.   Bond:
Your pre-paid bond cannot be used towards your cash fee due before departure. Otherwise, we hold no damage security bond.

BOND PAYMENT to secure your Vehicle
As discussed, we have tentatively reserved your booking, which places you under no obligation until we receive your bond which is now due.
Remember: Its first come first served due to the demand – the sooner the bond the sooner the guaranteed booking.
Below are details on how to secure your booking and get the bond to us.
To confirm and secure your booking please pay the requested bond amount and add your booking number or name as a narration with your payment.
That way we can identify that the payment came from you and can be receipted.

Payments made by Credit Card or Debit Card incur an additional 2.9% Surcharge, the cost to us!
No Charge if you transfer directly. (see above details) and provide a screenshot.
Payments can be made via cash (in advance or on the night), Bank Transfer, bank deposit [sent receipt] (7 Days in Advance), Visa or MasterCard (No Amex) (over the phone) Call 0427553340.
*Note the bond will be refunded in cash at the end of your tour unless alternative methods are made, which are stated in your tentative Nightcruiser booking email.
7.   Damage Inspection before Departure:
We suggest that when you initially board and pay your fee due, before your guests’ boarding, you also inspect the vehicle for any damage before departure. That way there will be no dispute as to when the damage occurred.
8.  After midnight Charters:
We and our Representative reserve the right to full payment including the bond in advance for any charters starting after midnight.
9.  Payment due. Full Amount Due Before Boarding:
As per the agreement, is to be paid in cash, (unless otherwise arranged in advance. No cheques are accepted unless first cleared and 5 working days is needed to have them cleared before boarding and departure in full to the driver by the person who is responsible for the charter. Cruiser Captains do not carry any change.
10.   Collection of Monies:
Under no circumstances is it the responsibility of the Driver to collect individual passenger money, should you be collecting from your guests towards the costs. It is you who is paying the total for the service as you are the Hirer of the Vehicle and Service.
11.   Arrival Cancellation:
If a chartered vehicle arrives at the pickup point and the responsible client does not wish to go ahead, for whatever reason, the total charge for the charter is still due, to less anticipated fuel costs not used, by negotiations with the depot operations manager at the time.
12.   The responsibility for Guests’ Actions:
As the hirer of the chartered vehicle, you are responsible for your guest’s actions. All Drivers are within their legal rights to evict any or all persons at any time if they are causing a disturbance, deemed to be acting in a manner that could cause the vehicle to have an accident, causing unruly behaviour, are heavily intoxicated, or insist on consuming alcohol on board.
13.   You are Responsible:
The vehicle/s will not carry any person from your party unless you, the responsible hirer, is on board. We will keep the bond until your guests have departed the vehicle/s at the end of the charter. If you will not travel with the charter you must allocate and nominate an adult to take your place to fully accept the responsibility and the booking must be in their name.
14.   Teen Fun Bus and Kids Party Bus Tours Adult Supervision: Suitable Adult supervision must be provided as instructed by the Nightcruiser Crew. The number of adults is dependent on the number of passengers. The driver can not supervise any group other than carrying out his responsibility under the Transport Act.
15.   Liability:
All reasonable precautions, safety and due care will be taken, however, in the case of sickness, accident or injury by any passenger, Nightcruiser and or its Sub-Contractors take no responsibility for the costs or actions taken against them, while at all times ensuring the best possible care and attention.
16.   Travel Insurance:
We recommend if thought necessary by you and your passengers to protect against sickness, medical expenses, ambulance transport, loss of earnings, accident, and/or unforeseen circumstances. They do so at their own expense and this should be pointed out in advance by the charterer to their guests.
17.   Sub-contracted out:
Nightcruiser sub-contract out its tours and charters to various Sub-Contractors and you agree to this service. All subcontractors have agreed to provide the licensed out services to Nightcruiser’s strict company policy.

18.   Late Arrival, Delays, Breakdown or Sub-contracted out:
Be assured that we always do our utmost to provide the service booked, arrive on time, even arrive in advance at times. However, if delays occur due to mechanical failure, traffic conditions, sickness, provision of a sub-contracted vehicle instead of a Nightcruiser Party Bus or without Nightcruiser livery or any other cause, you agree not to make any claim against us.
If there is an unforeseen circumstance before or during the Booking, the Sub-Contractor will provide a substitute vehicle.
The substitute vehicle or other mode of transportation does not have to be the same standard as the original vehicle booked.
An unforeseen circumstance includes but is not restricted to:
Mechanical breakdown [e.g. Before the date or during the day of service];
Traffic congestion;
Natural Disaster
A road traffic accident; or any other
19.   All of the agreed itinerary/ schedules need to be maintained:
Times or venues cannot be changed during the agreed tour as venues have accepted bookings for the time booked and may not grant access if late arrival.

20.   Loss of Bond:
If changes to the schedule made and non-arrival at the booked venue.
Venues are booked for and on your behalf as an additional courtesy service by the Nightcruiser Booking Crew. Venues hold the time slot free so we don’t get turned away at arrival. You must agree to maintain the agreed tour schedule and it can not be changed during the tour. You will lose your bond automatically as venues; especially Wineries will make financial loss claims against Nightcruiser Party Bus Tours. If the claim is greater than your bond, we will reclaim any additional charges from you, to which you agree.
21.   We Can Not Accept Responsibility:
If Venues, Police / Council Rangers/Parking Inspectors ask us to move on without allowing disembarkation. As we always comply with laws, you agree not to make any claim against  Nightcruiser and or Show World Corporation Pty. Ltd. trading as Nightcruiser and its Sub-Contractors, as this is out of our control.
22.   Free booked VIP entry:
Deals and all other arrangements are obtained on behalf of you and your guest’s as a complimentary additional service by the Nightcruiser Booking Crew. These provisions are provided directly by the Venues and are out of our control. We can not offer any guarantees or entertain any comebacks if what we have arranged is not provided. You agree not to make any claims against  Show World Corporation Pty. Ltd. trading as Nightcruiser or its Sub-Contractors. Some Venues require additional entry fees and have strict dress codes and once reached their patron limits cannot allow additional patron in by law. Additional entry fees might apply.
23.   Wine, Beer and Spirit tasting Disclaimer:
All Wineries, Breweries and Distilleries could charge a tasting fee which is not included in the Nightcruiser Charges. The venues request that you collect the fees from your guests and pay them in one lump sum.
24.   Non Entry to Venues:
If Authorities change the trading hours or conditions of entry or deals to a venue for whatever reason, you agree not to make any claim against the Adelaide Sub-Contractor, as it is not within our powers to demand deals or entry. It is up to the client to check with the venue in advance for any change.
25.   Time loss:
Or any personal expenses, entry fees incurred as a result of delays, alteration or curtailment of any charter, whether caused by mechanical defects, flooding, civil commotion, riots, terrorism, driver mistakes or any other cause, are the responsibility of the Charterer. We always try our hardest to maintain all schedules and understand the importance. If additional expense is incurred for taxis or other transport you agree not to make a claim against us.
26.   Sensible Alcohol Consumption:
You agree to the tour schedule and detailed arrangements emailed to you and accept that NO ALCOHOL is allowed to be consumed on board or opened alcohol carried by law and a function license is required. More details are listed with your booking confirmation emails.
27. Keep inside at all times
It is illegal to throw any items out of the window and or have hand, arms, heads or bodies handing out of the windows.
This includes plastic drink bottles or cans.
28.   Bus/Vehicle Groups or Charters:
Where a person is in charge or in control of any unlicensed premises (this includes any vehicle) and allows or suffers those premises (or vehicle) to be used as a place for consumption of liquor, that person commits an offence. Maximum Penalty: $1000 and possible loss of license.
29.   Street Drinking:
It is an offence for a person to consume liquor on any road, park or reserve within the boundaries of the metropolitan area or of a town or townsite, whether on foot or in a vehicle. Minimum Penalty: $200, Maximum Penalty: $1000+
30.   Passenger Property Loss:
All property and valuables remain the responsibility of their owners. Drivers are not permitted under strict company policy to store, look after passengers’ goods or clothing or hold the property for Safe Keeping.
Nightcruiser and or their Sub-Contractors cannot take responsibility for items left on vehicles and or are lost or stolen. If any property is found deemed lost, it is held at the Sub-Contractor’s Depot after entering it into a Lost Register. We will not be liable or will not pay for damage to property or clothing which belongs to any person in vehicles including trailers. We take no responsibility for the lost property while waiting collection.
30a. Electronic devices disclaimer [iPhone, iPods and other devices including connection cords]: Nightcruiser and it’s chosen Sub-Contractors encourage the use of Laptops, Tablet, PCs, iPhone, iPad, iPod and Smartphones for the purpose to allow passengers to bring their own music. Nightcruiser and it’s Sub-Contactors cannot accept any responsibility for such electronic devices or cords against any damage, loss whilst on the vehicles or damage electronically.
At no stage must they be left unattended with Nightcruiser Captains at any time. All Charterers must advise their guests of this fact and agree to do so.
While we carry suitable connection cables, but can not guarantee this, therefore any connection leads required should be brought along by Charterers. e.g. for Computers, Tablets, iPhone etc.
31.  Soiled and or damaged Clothing:
We have a regular routine cleaning program in place; however, we ask you and your guests to check seats prior to use as we will not accept responsibility for any soiled, damaged or torn clothing resulting from seats, the interior or exterior of the vehicles.
32.   Photo IDs: Are imperative for all patrons entering licensed premises. It’s their responsibility to have them available. Some venues now require 2 ID’s.
33.   Under Age: Persons taking responsibility for these terms and conditions must be of legal age, 18 years and over. If any passengers are found to be underage on alcohol-related tours, they will need to make their own way home at their own expense and can not stay on board with the Nightcruiser during the duration of the organised total schedule.
34.   Conduct Code is Simple: “Nightcruiser” and its Sub-Contactors operate under its own strict Code of Conduct and any fighting, rioting, vandalism, unruly and abusive behaviour/language in or outside vehicles, in public or venues, damage to personal property, passengers or property of the Nightcruisers will result in the immediate termination of a tour/charter and withdrawal of the Nightcruiser Party Bus Tour or services. Nightcruiser Party Bus Tours are foundation members of various Accords and strictly abide by these codes. Nightcruiser is a foundation member of the Nightclub Tours Operators of Australia, Gold member of the Party Bus Association of Australia and their code of conduct. 35.   Vehicle Damage: Where the vehicle is damaged by you or your guests, or left in an unpleasant condition (e.g. Vomit), the vehicle may be withdrawn immediately, and if deemed necessary, all bond may be kept. If you or your guests cause excessive damage, Nightcruiser and or its Representatives will take action to recover all costs incurred. Vomit will incur an automatic $50 disinfection charge and or loss of Bond.
36.   Breaking of Emergency Windows: Back Window, Roof Emergency Exit vents, Middle or Front doors without an emergency will incur an automatic replacement cost, plus new signage charge. Total approx. $550.00 depending on the damage.
36a. Transport regulations:  Replacement only by licensed tradesmen.
37.   Fire Extinguisher and First Aid Kits: If abused by passengers they will need to be replaced and charged to Client.
38.   Venue Dress Standards and behaviour rules: It is the individuals’ responsibility to make sure they adhere to venues dress codes and behaviour rules.
39.   Musical Requests: Clients are welcome to bring own CDs and iPhones, iPods or other devices to play their own music at their own risk. Suitable connection cords should also be supplied. Sub-Contactors carry music copyright licenses and are members of APRA and PPCA
40.   Power Sound System:
Amplifiers and Speakers are maintained and checked prior to departure from the depot, should they fail during the tour you agree not to make any claim against us.
We will endeavour the repair or replace during your tour but feel the continuation of the tour/transport is paramount.
41.  Weather:  Weather Conditions cannot be used as a reason to cancel Nightcruiser services
42.  Payments: Bond payments must be received in advance before we confirm your booking.  Payments for the Job must be made upon arrival in cash prior to service allowing you to collect from your guests.
All payments can be made in advance via:
1.Visa or MasterCard (No Amex) (over the phone).
2. Pay anybody Bank Transfer.
3. Direct over the counter bank deposit or
“Last minute” guests are more than welcome and the Crew will provide you with the different payment options.
Electronic transfers carry no charge and must reach us by the due date. Payments made by Credit Card incur a small additional 2.9% Surcharge.
43.  Price change and Money due: You can not change the price agreed to prior to departure with the service. If you experience fewer passengers turning up, and you are sharing the costs with your guests it is your responsibility to make up the difference or increase the per head basis you collect towards your cost.
The bond can at times be used towards payment if authorised by the Operations Manager and will not be refunded or cannot be claimed at a later time.

44.Covid-19

It is the responsibility of the Hirer to ensure all government laws, signage displayed, requests by the Driver or Company and all procedures related to Covid-19 are adhered to. The Driver and Company reserve the right to refuse entry or terminate a charter if any passengers are exhibiting symptoms associated with COVID-19 and will not be liable for any costs associated with this. We will require a passenger manifest with each passenger’s full name and contact number prior to your departure in writing.Where we have transported a passenger who becomes infected with Covid-19, the Hirer is responsible for notifying the Company immediately.The above Terms and Conditions still apply, however, our cancellation policy will differ due to COVID-19 related matters.45. COVID POLICY
Nightcruiser Party Buses and our Sub-Contractors [Suppliers] endeavour to follow the safety guidelines as set by the AU Government for the various COVID-19 Levels.

  • If the region where the event is booked is in lockdown level 3 or 4 and we (Nightcruiser Party Buses and the supplier) cannot provide the event as planned due to the level restrictions, where possible, the event will be postponed to a future date agreeable with all parties. This way we are protecting all the businesses involved and the work that everyone has put into planning your event to date.
  • Where an event cannot be rescheduled, we will offer a full refund of your bond where our Sub-Contactor [Supplier’s] COVID policy allows but your deposit is non-refundable as stated at the interim in your booking email. Due to the time of the year, a very small number of our suppliers only offer postponement of events and packages booked. In this instance, Nightcruiser Party Buses will be indicated in the proposal text under those packages and suppliers affected.
  • If the region where the event is booked is in level 1 or 2 – the event can go ahead, and it will go ahead as originally planned. Please refer to our normal cancelation rules. No refunds are given should the number of guests have dropped due to some choosing not to attend due to COVID or their region being in lockdown. Where possible, we can look at postponing your event, however, as stated in your booking email your deposit is lost if canceling.

    Postponement Terms
  • Pending the Sub-Contractor [Supplier’s]  postponement terms which are normally either 3 or 6  months from the booked event date, we will reschedule your event for a date that will suit both you and the affected Sub-Contractor [Supplier].
  • Please note that if funds have been forwarded to the Sub-Contractor [Supplier] already in terms of a bond or deposit or final payment and for any reason, in the postponement time frame the supplier goes into receivership, Nightcruiser Party Buses is not liable and those funds can’t be claimed back through Nightcruiser Party Buses. For your event to go ahead, Nightcruiser Party Buses would have to book another Sub-Contractor [Supplier] and a new Booking email with costs would be issued.
  • We are happy to postpone the event wherever possible however it could occur an admin fee. This will apply each time you change the date.

46. LIMITED LIABILITY Nightcruiser [Agent]
46.1 If a liquidator, trustee, receiver, administrator, administrative receiver or similar officer is appointed over the Sub-Contactor [Supplier] and if your [Buyer] deposits, bonds, job fees have been forwarded to the Sub-Contactor [Supplier] you agree not to claim any monies paid to us. They need to be claimed from the Sub-Contractor [Supplier].
46.2 You [Buyer] agree not to claim any damages against us, caused out of the consequence of the Sub-Contractor’s actions, not providing the services or refunding any funds, agreed not to claim again us [Agent]
46.2 You agree not to claim any damages that might have been caused due to any loss of the Sub-Contractor’s action.

47. FORCE MAJEURE
47.1 The Agent reserves the right to defer the date of delivery or to terminate the Relevant Obligations or alter the Services ordered by the Buyer (without liability to the Buyer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of the Agent including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, provided that, if the event in question continues for a continuous period in excess of 80 Business Days, the Buyer shall be entitled to give notice in writing to the Agent to terminate the Relevant Obligations.

48CANCELLATIONS DUE TO GOVERNMENT-MANDATED SHUTDOWN
In the event of a cancellation due to a government-mandated shutdown, you can change the date of your tour (provided it’s within 12 months) with the
following condition: Money that we have paid to venues to secure your booking and tasting MAY OR MAY NOT BE RECOVERABLE. This will depend on the venues’ policies and it is beyond our control.
We also cannot guarantee that the venue will be able to accommodate you at a later date.
We do NOT offer refunds in the event of a government-mandated shutdown.

Terms and Conditions Sub-Contactor No.2

Our Sub-Contractor [Supplier] endeavours to ensure your tour is a great success and lots of fun. They do have a few terms & conditions to ensure your day outing is what you expect from us.

Booking of our Buses
A deposit is required at the time of booking, this amount becomes non-refundable for whatever reasons.
Balance of payment including bond must be paid as per request in your booking email at least 18 days out from your travel date.
The security bond will be refunded after the travel date if there are no damages to the bus or venues visited reported.

If passenger numbers rise or drop, we will accommodate where possible, but 2 weeks out from a tour is our cut off for size changes and price changes.
NO SMOKING is permitted on any of our buses. (It is against the law in South Australia to smoke in a Public Transport Vehicle)
Passengers must not interfere with any equipment inside the vehicle at any time.
All lost property will be returned to the Sub-Contractor’s Bus office and registered in our Lost & Found Register.

Bus Behavior
The Driver is authorised to have an unruly passenger removed, who is threatening or placing the driver or passengers in a dangerous situation. (The removal of a passenger will not occur if it places that passenger at some form of risk, but the matter may be reported to the Police if deemed necessary by the Driver or the Management of Our Sub-Contractor [Supplier]

Alcohol on the Bus
Follow this link to obtain your Limited Liquor Licence with the SA Government, please ensure you read the terms and conditions prior to obtaining your Limited Liquor Licence. You can bring some eskies and consume alcohol on our buses. We allow most drinks, like Champagne, white wine, beer, etc, but we don’t allow Red wine, or Sparkling Red, as it can stain the seats.

We recommend only bringing around 3 drinks per person. Remember if you are going to 3 wineries, you may taste over 20 different wines, so the day is about pacing yourselves. Remember to bring water.

When obtaining your permit you will need a credit card and the rego number of the bus which will be supplied to you when you paid the deposit on your bus hire.

BEER MAY ONLY BE CONSUMED IN CANS NO GLASS BOTTLED BEER IS PERMITTED ON BUSES
Cans, or wine bottles are ok on the bus. NO GLASS BOTTLES ON THE BUS unless white wine or sparkling bottles.
If you have obtained your limited liquor licence,(refer to our website for instructions) you can bring some eskies and consume alcohol on our buses. We allow most drinks, like Champagne, white wine, beer, etc, but we don’t allow Red wine, or Sparkling Red, as it can stain the seats.
As per South Australian Liquor Licence Laws all.
ALCOHOL MUST REMAIN ON BUS and not permitted to be taken into wineries or venues and not to be consumed in car parks or next to the bus.

Eskies on the Bus
Buses don’t have a lot of space so these are the esky limits per bus size It is also to do with your comfort and safety, & large eskies can damage seats and windows of the bus

SECURITY BONDS
The Sub-Contractor requires a refundable bond to be paid on all licensed tours.
The bond for 13 seaters is $100, bond for all other buses is $300 but could be more on bucks or hens days.
No negative feedback from wineries, hotels, breweries or any other businesses
The bond will be returned after the tour date providing:
There is no damage to the bus
No one has vomited on the bus
No street signs were stolen or any acts of vandalism
Any other issues that could fall under the unacceptable category
Nothing was stolen or damaged in any venues
The bus wasn’t left in an unduly messy state.

Terms and Conditions Sub-Contactor No.3

FINANCIAL:
1. Any deposit paid by the Client [Buyer] is deemed as an acceptance of these Terms and Conditions.
2. All deposits are non-refundable and to secure the vehicle, are due within 5 Days of Booking unless prior
arrangements have been made. (Check your  Nightcruiser Booking email)
3. The Client agrees to pay the balance due 14 days prior to the booking date by direct debit, cheque or money order
for all bookings.
4. FULL PAYMENT IS TO BE FINALISED BY THE DATE OF HIRE.
5. Any payments overdue will incur a 10% surcharge.
6. Credit Card facilities are available for immediate phone bookings to secure vehicles and incur a service fee of 2%
for all payments.
BOOKING TIMES:
1. The Client agrees to adhere to their booked start and finish times and accepts that any overtime outside of these
times will be charged accordingly.
2. Overtime will be charged at the non-discounted hourly rate.
3. Refunds will not be given upon early completion of pre-booked times.
4. The Limo Sub-Contractor [Supplier] does not accept responsibility for lateness caused by the Client.
5. All one-hour bookings will allow up to 2 pick-up locations that are in close proximity and arrive at the booked
destination in time. Be sure to allow enough time for “Happy Snaps”.
6. Each extra pick-up will incur a $20.00 fee, plus overtime if applicable.
7. If you feel that you may be pushing to be at a destination on time, we advise that you book a little earlier and allow for
extra time.
CANCELLATIONS:
1. The Client agrees that the cancellation of a booking will result in forfeiture of the deposit.
2. Where the vehicle remains unbooked for any canceled booking time, a fee of up to 100% of the original booking fee
– may be charged, weddings included.
3. Strictly NO REFUND if cancelled within 14 days of the booked date.
BEVERAGES:
1. After complimentary drinks are consumed, any additional beverages will be at the Client’s time & expense.
2. ALCOHOL CAN NOT BE CONSUMED BY PERSONS UNDER THE AGE OF 18.

1. The Limo Sub-Contractor [Supplier] reserves the right to substitute any vehicle with another vehicle or refund any amount paid if we are unable to provide a vehicle due to an emergency or conditions outside of  The Limo Sub-Contractor [Supplier] control.
2. Breakage of glasses will be charged to the Client at $10 per glass.
3. Under no circumstances is any part of the passenger’s body to protrude from vehicles,
THIS IS AGAINST THE LAW and if this occurs, the hire will cease until the offending person(s) are removed from
the vehicle. This includes the Hummer Roof Hatch, which is for Emergency Use Only.
VEHICLE ACCESS:
1. Due to the physical size of each vehicle, there may be times when it will not be possible for the vehicles to access
every driveway, road or venue.
2. The Chauffeur will endeavour, where safety permits, to access all locations, however, if the safety of the passengers
and/or the vehicle is compromised, the Chauffeur has the authority to select the appropriate passenger boarding/disembarking locations.
GENERAL:
1. The Client making the booking is responsible to ensure all passengers are aware of these conditions and is also
responsible for any damage to the exterior, interior, and/or contents of the vehicle.
2. The Limo Sub-Contractor [Supplier] Chauffeurs are under strict instructions to stop and not proceed if they believe any person is not in a fit
state to travel (this includes intoxication, unruly behaviour or any damage to the vehicles.)
3. The cost to sanitize the interior of a vehicle commences a $250 and increases depending on the extent of the problem. In
addition, the Client will be charged for any work the vehicle is unable to attend due to this downtime. Costs will be
charged to the Client’s Credit Card or paid by cash at the time.
4. The Limo Sub-Contractor [Supplier] will not be held responsible by any person or persons, company or syndicate for injuries sustained and
are absolved from any and all liabilities.

Standards of behaviour

As the contact person for your group, you are the only person I am in communication with. So a major responsibility rests with you in the selection of your friends for this tour and their behaviour on and off the bus.  You must make everyone in your group aware by emailing a link to this page or printing it out for them. If you are unsure of any one of these conditions, you agreed to ask and receive clarification before booking.

At our Sub-Contractor’s Winery and Brewery Tours & Party buses, we really want you to enjoy your tour. We put a lot of effort into presentation, equipment and scheduling. If you have a great day out, then you will tell your friends. After you have been on a Partybus cruise jiving to your music LOUD amongst the strobe lights of an evening, you will already have ideas about what occasion to include the Partybus in next.

Unfortunately, all of this fun and frivolity can be too much for some. You know the story – it only takes one bad apple. Just one “friend of a friend” who can’t handle his/her alcohol. Hence BYO is limited to three (3) drinks per person per hour and can include white wine (still or sparkling), beer, cider or commercially available ready to drink pre-mix such as scotch & cola and vodka cruisers. Not permitted are red wine, liqueur or straight spirits.

Liquor licensing laws in South Australia are quite user friendly, but also carry heavy fines. A security bond is payable for every event. This bond is refunded at our absolute discretion after the event pending positive feedback from our driver/host and venue staff.

When inquiring or placing a booking with us you expressly agree to our below Terms & Conditions, agree to adhere to refrain from Unacceptable Behavior and agree to cover all and any Additional Costs.

So for you, your driver, and all other people who may see and hear us on the day to have a positively memorable experience, here are some house rules:

Terms & Conditions

Quotes and prices

  • All published prices for vehicles and venues are a guide only and are subject to change without notice
  • Written quotes are valid for 30 days
  • Your booking is accepted as confirmed with us once we accept it in writing
  • Each job needs to be fully pre-paid.  Payments become non-refundable within 30 days of your event
  • Unscheduled stops, additional guests, waiting or overtime may attract additional charges.  Group transfers include a 10-minute gratis grace period, after which waiting time is payable.

Vehicles

  • Vehicles have photo, video and sound recording devices. All sound and vision obtained is the property of the Sub-Contractor, and you consent to its unconditional use
  • We reserve the right to substitute vehicle size and type at our absolute discretion
  • We may use more than one vehicle & driver for any event, tour or transfer at our absolute discretion

At times circumstances dictate vehicle changes and substitutions.  We do our best to meet and exceed your expectations at all times because we WANT you to have a great time and come back again and again.  But on rare occasions, circumstances beyond our control may force our hand including but not limited to vehicle maintenance, mechanical breakdowns, driver availability, weather, and unexpected scheduling changes.

Event planning

  • We often make venue bookings for tastings, meals and other visits for your group
  • You may need to pay a deposit to secure a venue visit, either to us to to the venue directly
  • Some venues require you to make contact with them directly, and you agree to do so without delay
  • We have no control over the accuracy, quality or quantity of any venue’s offerings, eg drinks or food; any recommendations offered are purely based on past experience and are not intended to be guarantees of any kind
  • All itineraries remain our intellectual property.  Venues and times may only be changed or cancelled by us unless otherwise agreed to in writing.  If you cancel your bus booking with us, then we will likely re-use those scheduled visits for other groups
  • We offer the service of providing eskies for your use.  You may choose to use your own eskies, however, these MUST be removed from the vehicle at the conclusion of each trip, including any transfers where our driver may leave to carry out other work.  (Also see After Event lost items below)
  • The driver will check the photo ID – U18 must not consume alcohol on licensed premises
  • Strictly no alcohol consumption in vehicles for school formals regardless of age

On tour

  • Whilst on tour you and your guests EXPRESSLY AND IRREVOCABLY agree to adhere to our published Standards of Behavior on board and at venues including car parks, conveniences and all other public spaces.  See “Unacceptable behaviour” examples below
  • At the conclusion of your event, you and your guests agree to thoroughly check that everybody takes off the vehicle with them all personal belongings, purchases etc.
  • Any item(s) left on a vehicle after an event may be forfeit.  We will do our best to reunite an owner and their phone/wallet/keys etc, and you agree to bear any cost incurred in that process.  Food or beverages including alcohol left behind will be discarded.

After Event

  • In the week following your event, you will receive an email asking you for feedback about your experience
  • Bonds may be returned AT OUR ABSOLUTE DISCRETION in full or in part pending driver and venue reports within 7 days of receiving your bond return instructions

Verboten! Unacceptable behaviour:

Any time during your event

  • Interfering with your driver in any way, including hair pulling, touching while driving
  • Abusive, aggressive, anti-social behavior of any kind including verbal to anybody including each other
  • Drinking games involving sculling of alcohol
  • Public nudity, urination, or similar
  • Theft, aka “souveniring” of items including drink glasses, signage, beer paddles

In vehicles

  • Smoking or vaping
  • Consumption of red wine (still or sparkling)
  • Consumption of alcohol in vehicles without a liquor license
  • Bringing open GLASS containers onto a bus without EXPRESS permission from us
  • Removal of open containers of alcohol from a vehicle at a venue without EXPRESS permission from the venue
  • Opening of doors while the vehicle is in motion
  • Ejecting any item whatsoever out of a vehicle
  • Placing body parts outside (eg out of a window) while the vehicle is in motion
  • Interfering with equipment or fittings

At venues

  • Not following reasonable directions of staff or driver
  • Swearing, foul language or excessively loud or obnoxious behaviour
  • Bringing alcohol into a licensed venue – including the car park

Many wineries and eateries are family-oriented. We go there all the time even though you may not. It is important to respect staff, your diver, and other visitors.

Any breach of these conditions can lead to the offensive person being ejected from the vehicle and/or the whole tour being terminated immediately, wherever the bus may be, including the very first collection address! Your bond may be forfeited.  You will need to arrange your own way back home at your own cost.  There will be no refund.

Additional Costs

In ADDITION to any money you have paid, you agree to pay immediately on demand the cost of any of the following caused by any member of your group, regardless of how well you know them:

  • Damage of any kind to the vehicle or at venues
  • Theft, aka “souveniring”
  • Replacement items in case of breakage/damage
  • Cleaning of vehicle/venue after unreasonable soiling, including excessive dirt/mud, blood, vomit, drinks or any other spillage including leaking drink containers/eskies.

These lists are not exhaustive, and additionally, you may be reported to SAPOL or another authority if there is suspicion or evidence of illegal activity.

By placing a reservation with our Sub-Contractor you expressly agree to be bound by all of our terms and conditions.

We understand and agree with the following conditions set by the Sub-contractor. Any deposit is an

STYLE 14 passengers in rear;

MERCEDES SILVER SPRINTER LIMOUSINE STYLE 12 passengers in rear and 2 in front
SEATBELTS ARE TO BE WORN. STRICTLY NO VAPING OR SMOKING IN VEHICLES.
1. We agree to payment in full 2 weeks before the date by direct debit or credit card by
phone. If full payment is not received the booking will not proceed. (Check your Nightcruiser booking email)
2. The booking customer is responsible for ensuring all passengers are aware of these
conditions; and is also responsible for any damage to the exterior, interior, or contents of the
vehicle.
3. All deposits are non-refundable and due within 3 days of booking unless prior arrangements
are made. We agree that cancellation of this booking will result in forfeiture of our deposit.
4. We agree to adhere to start and finish times and accept that any overtime will be charged at
the non-discounted hourly rate.
5. Refunds will not be given should the client choose to end the ride before the pre-booked
time.
6. The Sub-Contractor accepts no responsibility for lateness caused by the client.
7. The Sub-Contractor reserves the right to substitute any vehicle with another vehicle or refund in full
any paid amount if we are unable to provide a vehicle due to an emergency or conditions
outside of our control.
8. Breakage of glasses will be charged at $10.00 per glass
9. Drivers are under strict instructions to stop and not proceed if they believe any person is not
in a fit state to travel, inclusive of unruly behaviour and any excessive mess made. The cost to
sanitise the interior of the vehicle starts at $250 and increases depending on the extent of
the problem.
10. All one-hour bookings will allow up to 2 pick-up points that are in close proximity and allow
for on-time arrival. If wanting to stop for photos please allow for this when booking. It may
pay to book an extra 30 minutes to ensure a relaxing trip.
11. Alcohol cannot be consumed by those under 18 years of age. Under no circumstances can
hard liquor be consumed in the vehicle. Pre-mixes are allowed but please consult us before
bringing your own alcohol on board.
12. Weddings must not be booked as general transfers without prior consultation.
13. Under no circumstance is any part of the body to protrude from the vehicle. This is against
the law and may result in the termination of the ride.
14. We shall not be held responsible to any person or persons, company or syndicate for injuries
and are absolved from all liability.
CLIENTS, PLEASE NOTE:
DUE TO THE PHYSICAL SIZE OF THE VEHICLES, THERE MAY BE TIMES WHEN IT WILL NOT BE POSSIBLE FOR THE VEHICLE TO ACCESS A DRIVEWAY, ROAD OR VENUE.
THE CHAUFFER WILL THEN STOP AT THE NEAREST SAFE LOCATION.

Terms and Conditions

BOOKINGS

Booking acceptance:

All vehicles are quoted subject to availability at the time of booking.

PAYMENTS, REFUNDS & CANCELLATIONS

Payments:

  • All reservations require a major credit card.
  • We accept: VISA, MASTER, Debit Cards, Pay-wave, Cash & Direct deposit. [Check your Nightcruiser Booking email]

Refunds & Cancellations:

Reservation payments are finalised upon conformation in full for all bookings within 14 days. Only 50% deposit is required for all advance bookings. Full payments and deposits are non-refundable. (In case of family emergency or acts of nature, your booking will be changed into three months gift certificate).{More details in your Nightcruiser Booking email]

EXTRA CHARGES

Waiting Time:

  • Additional charges will incur for waiting time.
  • Waiting time charges will be exempt for late interconnecting services and bad traffic conditions.
  • Charges are calculated at $30 per 15 minutes for corporate vehicles and $40 per 15 minutes for stretch vehicles.
  • All additional stops are calculated at $20 for corporate cars and $50 for stretch limousines.

After-hours services and public holidays:

A 20% surcharge will be applied to any trips commencing after midnight until 5am and on all public holidays.

Incidental charges:

  • If anyone gets ill in the car there is a $350 clean up charge.
  • Client and renter are responsible for his/her guests, for any damage to the interior and equipment of the vehicle. This is including but not limited to: gum, wine and alcohol spillage, vomiting, breakage of champagne, wine and drink glasses, breakage of decanters, breakage of lights, television, DVD, radio, CD player and touch screen devices.
  • All repairs and replacements of items shall be charged at the market value of a new item.

No show charges:

  • To avoid a no-show fee (Total deposit forfeited) please do not leave your pre-requested pick up location without speaking to your chauffeur first.
  • For all arriving flights, meet your driver at the arrival gate or if requested at the baggage claim area.

Late interconnecting services:

There are no fees or charges if your interconnecting services are running behind schedule, we will return to collect you at your new arrival time (subject to availability).

PASSENGER RESPONSIBILITIES

  • Possession, sale or consumption of any type of narcotics or illegal drugs is prohibited and dealt in accordance with the state law.
  • High levels of intoxication will not be tolerated, The Sub-Contractor reserves all rights to ban or refuse any passenger/s from entering, consuming or bringing additional alcoholic beverages on board of our vehicles if passenger/s is/are deemed as unsafe and not in position to make logical decisions.
  • Alcohol consumption is not permitted in our corporate fleet.
  • All decisions will be made in accordance of Queensland state law and liquor licensing.
  • Hanging out of windows or sunroof is strictly prohibited.
  • Smoking in the vehicles is strictly prohibited.
  • Violations will result in immediate termination of contract and services and forfeiture of all paid deposits and fees for service.
  • While we are happy to let you bring personal CD’s, DVDs, Bluetooth devices and other various personal items we do not take any responsibility for items that are left in the vehicle during or after completion of the limousine rental period.
  • The Sub-Contractor will not be held responsible for any lost items in our vehicles, all receovered lost times will need to be collected from The Sub-Contactors Office by appointment.

CHAUFFEUR RESPONSIBILITIES AND RIGHTS

  • The Sub-Contractor chauffeurs have the right to apply additional transfer charges if required.
  • The Sub-Contractor chauffeurs are randomly drug and alcohol tested.
  • The Sub-Contractor chauffeurs are all Queensland (QLD) DA accredited.

FURTHER MORE

  • The Sub-Contractor reserves the right to expel any person from the vehicle and/or terminate this contract in the event of a violation of any of these conditions by any passenger.
  • In the event of such early termination, no portion of the rental fees shall be refunded.

The Sub-Contractor and Nightcruiser shall not be held responsible for:

  • Late arrival caused by (but not limited to)!
  • Acts of nature
  • Traffic delays
  • Breakdown
  • Incorrect pickup and drop-off information
  • And any situation beyond our control
  • For not providing any additional extras/special requests if such information was not given by the customer at the time of booking.
  • In the event any part of this contract is declared unenforceable, the remaining provisions of this agreement shall remain in full force and effect.
  • If the limousine rental is for a minor up to the age of 16 an adult must accompany a transfer.

SUBSTITUTE OF REQUESTED VEHICLE

  • The Sub-Contractor reserves the right to substitute the limousine or the colour of the vehicle at its own discretion.
  • The Sub-Contractor reserves the right to providing you with substitute vehicle through our affiliate partner program and release some of your personal information in accordance with our privacy policy.

CUSTOMER DECLARATION

  • By accepting the booking, all passengers are protected by our public insurance policy after all doors are secured and only whilst the vehicle is in motion. Seat belts must be worn at all times by all passengers.
  • I agree to the terms and conditions of this agreement. I declare that I am over the age of (18) eighteen and my booking confirmation acts as my signature with full agreement and understanding of the terms and conditions described above.

PRIVACY POLICY

The Sub-Contractor is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the National Privacy Principles (NPPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Federal Privacy Commissioner at www.privacy.gov.au.

Sensitive Information:

Sensitive information will be used by us only:

  • For the primary purpose for which it was obtained
  • For a secondary purpose that is directly related to the primary purpose
  • With your consent;or where required or authorised by law.

Third Parties:

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information:

Your Personal Information may be disclosed in a number of circumstances including the following:

  • Third parties where you consent to the use or disclosure
  • Where required or authorised by law;and
  • When providing your information to our affiliates partner
  • Sensitive date will never be provided through our affiliate program

Security of Personal Information:

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently delete your Personal Information. However, most of the Personal Information is or will be stored in client files, which will be kept by us for a minimum of 7 years.

Access to your Personal Information:

  • You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
  • Dreamslimo will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information:

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Terms and Conditions Sub-Contactor No.7 Party Boat

The Sub-Contractor  requires a $250 deposit to secure a tentative booking for a period of 14 days.
Full payment is required within 14 days of a tentative booking to confirm your booking.
If not confirmed and paid for in full within 14 days the date will be made available to other clients.
Whilst every endeavour is made to establish efficient communication with potential clients, confirmation of tentative bookings on the Popeye, rests solely with the client.
Full payment is required for bookings made less than 4 weeks prior to an event.

Deposit Refund 
Hirers must respect the property of the Sub-Contractors Boat.
A carpet-cleaning surcharge will be incurred for any function where the carpet has been soiled as a result of the event held by the Hirer. Compensation for damage to the Sub-Contractor or its equipment, including loss of equipment will be deducted from the deposit.
Decorations must not be hung on the fairy lights.
The $250 deposit will be refunded in full, within 7 days, provided no hire conditions have been breached.
The Sub-Contractor accepts no responsibility for loss or damage to the Hirer’s goods or equipment during the period that such goods or equipment are on the Popeye boat or in the Popeye office prior or post the Hirer’s event.

Cancellations
If the event is cancelled more than 4 weeks before the event, the hirer forfeits 25% of the deposit + Check your Nightcruiser Booking email.
If the event is cancelled less than 4 weeks before the event,  the hirer forfeits 100% of the deposit + Check your Nightcruiser Booking email.
If the event is cancelled 14 days or less before the event, the hirer forfeits 100% of the deposit and remaining hire fee. + Check your Nightcruiser Booking email.

The Sub-Contractor reserves the right to cancel any cruise due to unfit weather conditions (winds over 60km/h and/or extreme temperatures) at any point leading up to the cruise. In this case free rescheduling will be made available to the hirer.

Rescheduling
If your booking needs to be moved to a different day or time , The Sub-Contractor requires 4 week’s written notice to reschedule.
 You have two opportunities to reschedule.

Price Changes
If your event is booked more than 4 months in advance, your final price may be subject to change.

PARTIES / BUCKS / HENS SHOWS
No bottles of straight spirits or liqueur without express permission.
Our staff adhere to Responsible Service of Alcohol at all times and reserve the right to refuse service.
The person doing the booking is responsible for the behavior of their guests – If they are aggressive, disrespectful, disobeying the rules as set by the Maritime industry and our office or displaying dangerous behavior, the cruise may be canceled and all guests removed.  No refund will be given.
