    TERMS AND CONDITIONS FOR NIGHTCRUISER – Brisbane
    Below the Nightcruiser [ Agent] Booking Crew – Brisbane has put up the terms and conditions that you will need to agree with when accepting a booking.
    They were prepared in simple detail for your benefit and must be adhered to as we operate strictly in a law-abiding manner.
    By Paying your Deposit/Security Bond you [Buyer] automatically accept full responsibility and the Terms and Conditions below.
    This includes our chosen Sub-Contractors [Supplier] terms and conditions.

    1. 
     Responsibility and Sub-Contractor Services
    You must be over 18 years of age to make any booking, alternatively, your Parent or Guardian can make the booking on your behalf.
    When you call us we assume and you declare you are over 18 years of age.
    You and or your Parent or Guardian automatically agree, confirm and accept full responsibility to the set-out terms and conditions herewith when you pay your booking deposit/bond to Show World Corporation Pty. Ltd. trading as “Nightcruiser” for and on behalf of any Nightcruiser’s chosen Sub-Contractor carrying out the services.
    1 a. NIGHTCRUISER APPOINTED SUB-CONTRACTORS.
    You [Buyer] agree, accept and understand that Nightcruiser [Agent] will allocate a suitable chosen Sub-Contractor [Supplier] to carry out the Party Tour and Services as agreed. They will be in full control and assist you directly and you will abide by their own terms and conditions as well, listed separately at the bottom of this webpage. Furthermore, you agree to the emailed tour schedule and detailed arrangements.
    2. Communication:

    Email communication or faxes between our offices and clients are deemed and treated the same as a signed legal contract.
    3.   Booking Deposit / Bond:
    Must be paid in advance by the due date requested as stated and or attached to our emails to protect your date.
    Payment options are also detailed in your booking email and below 6.1
    4.   Refund of Deposit:
    We are unable to refund your booking deposit for cancellation for whatever reason and time.
    5.  Security Bond:
    The booking bond/deposit also automatically becomes your damage bond, once paid. It can not be used towards the fee due for the service at the point of pick-up. The Sub-Contractor might refund on the spot or as per their terms and conditions after the service back to your bank account. This ensures the right person receives the bond.It is your responsibility to ask the driver if he is happy to recommend a refund after inspection. We, therefore, require your Bank BSB and Account numbers to forward to the chosen Representative.If you have any dispute it can only be solved by the Sub-Contractor [Vehicle Owner Operator] and yourselves.
    6.   Bond:
    Your pre-paid bond cannot be used towards your job fee due prior to departure. Otherwise, we hold no damage security bond.
    6. 1 Deposit / Bond Payment Information:
    BOND PAYMENT
    As discussed, we have tentatively reserved your booking, which places you under no obligation until we receive your bond which is now due as per your booking email.
    Remember: Its first come first served due to the demand – the sooner the bond the sooner the guaranteed booking. Below are details on how to secure your booking and get the deposit/bond to us.
    To confirm and secure your booking please pay the requested deposit/bond amount and add your booking number or name as a narration with your payment.
    7.   Damage Inspection prior to Departure:
    We suggest that when you initially board and pay your fee due, prior to your guests’ boarding, you also inspect the vehicle for any damage prior to departure. That way there will be no dispute as to when the damage occurred.
    8.  After 12 midnight Charters:
    We and our Representative reserve the right to full payment including the bond in advance for any charters starting after 12 midnight.
    9.  Payment due. Full Amount Due Prior to Boarding:
    As per the agreement, is to be paid in cash, (unless otherwise arranged in advance. No cheque is accepted unless first cleared and 5 working days is needed to have them cleared) before boarding and departure in full to the driver by the person who is responsible for the charter. Cruiser Captains do not carry any change.
    10.   Collection of Monies:
    Under no circumstances is it the responsibility of the Driver to collect individual passenger money, should you be collecting from your guests towards the costs.
    11.   Arrival Cancellation:
    If a chartered vehicle arrives at the pickup point and the responsible client does not wish to go ahead, for whatever reason, the total charge for the charter is still due.
    11.1 Booking or schedule changes
    If the agreed schedule as stated in your booking email as agreed by you can not be changed nor a refund if the schedule is shortened or cancelled in the middle of a schedule.
    12.   The responsibility for Guests’ Actions:
    As the hirer of the chartered vehicle, you are responsible for your guest’s actions. All Drivers are within their legal rights to evict any or all persons at any time if they are causing a disturbance, deemed to be acting in a manner that could cause the vehicle to have an accident, causing unruly behaviour, are heavily intoxicated or insist on consuming alcohol on board.
    13.   You are Responsible:
    The vehicle/s will not carry any person from your party unless you, the responsible hirer, is on board. We will keep the bond until such time as your guests have departed the vehicle/s at the end of the charter. If you will not travel with the charter you must allocate and nominate an adult to take your place to fully accept the responsibility and the booking must be in their name.

    14.
       Teen Fun Bus and Kids Party Bus Tours Adult Supervision:
    Suitable Adult supervision must be provided as instructed by the Nightcruiser Crew. The number of adults is dependent on the number of passengers. The driver can not supervise any group other than carrying out his responsibility under the Transport Act.

    15.
       Liability:
    All reasonable precautions, safety and due care will be taken, however, in the case of sickness, accident or injury by any passenger, Show World Corporation Pty. Ltd. trading as Nightcruiser and the appointed Representative take no responsibility for the costs or actions taken against them, while at all times ensuring the best possible care and attention.
    16.   Travel Insurance:
    We recommend, if thought necessary by you and passengers to protect against sickness, medical expenses, ambulance transport, loss of earnings, accident and/or unforeseen circumstances. They do so at their own expense and this should be pointed out in advance by the charterer to their guests.
    17.
       Sub-contracted out:
    Nightcruiser [Agent] sub-contract out its tours and charters to various Sub-Contractors [Suppliers] and that you [Buyer] agree to this service. All subcontractors have agreed to provide the licensed out service to Nightcruiser’s strict company policy.
    18.   Late Arrival, Delays, Breakdown or Sub-contracted out:
    Be assured that we always do our utmost to provide the service booked, arrive on time, even arrive in advance at times. However, if delays occur due to mechanical failure, traffic conditions, sickness, provision of a sub-contracted vehicle instead of a Nightcruiser Party Bus or without Nightcruiser livery or any other cause, you agree not to make any claim against us.
    If there is an unforeseen circumstance before or during the Booking, the Sub-Contractor will provide a substitute vehicle.
    The substitute vehicle or other mode of transportation does not have to be the same standard as the original vehicle booked.
    An unforeseen circumstance includes but is not restricted to:
    Mechanical breakdown [e.g. Before the date or during the day of service];
    Traffic congestion;
    Natural Disaster
    A road traffic accident; or any other
    19.   All of the agreed itinerary/ schedules need to be maintained:
    Times or venues cannot be changed during the agreed tour as venues have accepted bookings for the time booked and may not grant access if late arrival.
    20.   Loss of Bond:
    If changes to the schedule are made and non-arrival at the booked venue. Venues are booked for and on your behalf as an additional courtesy service by the Nightcruiser Crew. Venues hold the time slot free so we don’t get turned away at arrival. You must agree to maintain the agreed tour schedule and it can not be changed during the tour. You will lose your bond automatically as venues; especially Wineries will make financial loss claims against Nightcruiser Party Bus Tours. If the claim is greater than your bond, we will reclaim any additional charges from you, to which you agree.
    21.   We Can Not Accept Responsibility:
    If Venues, Police / Council Rangers/Parking Inspectors ask us to move on without allowing disembarkation. As we always comply with laws, you agree not to make any claim against the Sub-Contractor or Nightcruiser and or Show World Corporation Pty. Ltd. trading as Nightcruiser, as this is out of our control.
    22.   Venues Information, Deals and Free booked VIP entry:
    Deals, Information and all other arrangements are obtained on behalf of you and your guest’s as a complimentary additional service by the Nightcruiser Crew. [If applicable and available in your area].
    These provisions are provided directly by the Venues and are out of our control. We can not offer any guarantees or entertain any comebacks if what we have arranged is not provided. You agree not to make any claims against our Representative/Sub-Contractors or Show World Corporation Pty. Ltd. trading as Nightcruiser.
    Some Venues for various reasons require additional entry fees and have strict dress codes and once they have reached their patron legal limits cannot allow additional patron in by law.
    Please note! Some of these services, however, might not be offered in your particular area.
    23.   Wine, Beer and Spirit tasting Disclaimer:
    All Wineries, Breweries and Distilleries could charge a tasting fee which is not included in the Nightcruiser Charges. The venues request that you collect the fees from your guests and pay them in one lump sum.
    24.   Non Entry to Venues:
    If Authorities change the trading hours or conditions of entry or deals to a venue for whatever reason, you agree not to make any claim against Nightcruiser [Agent] as it is not within our powers to demand deals or entry. It is up to the client to check with the venue in advance for any change.
    25.   Time loss:
    Or any personal expenses, entry fees incurred as a result of delays, alteration or curtailment of any charter, whether caused by mechanical defects, flooding, civil commotion, riots, terrorism, driver mistakes or any other cause, are the responsibility of the Charterer. We always try our hardest to maintain all schedules and understand the importance. If additional expense is incurred for taxis or other transport you agree not to make a claim against us.
    26.   Sensible Alcohol Consumption:
    Alcohol is permitted onboard on a limited BYO Basis. [Subject to what is stated in your booking email] STRICTLY NO Red Wine or Glass.
    A Reminder, venues reserve the right to refuse entry into venues and we highly discourage excess drinking.
    Food is STRICTLY not permitted onboard.
    Nightcruisers Sub-Contactors and or “Nightcruiser” encourages sensible alcohol consumption on licensed premises and therefore if any passengers are deemed too intoxicated or causing a disturbance they can be asked to leave the vehicle/tour and if given the option to travel home by taxi or other means do so at their own expense.
    27. Keep inside at all times
    It is illegal to throw any items out of the window and or have hands, arms, heads or bodies handed out of the windows.
    This includes plastic drink bottles or cans
    28.   Bus/Vehicle Groups or Charters:
    BYO is permitted on the vehicle and at the discretion of the Representative.
    No glass, including bottles or glasses, on the Bus.
    29.   Street Drinking:
    It is an offence for a person to consume liquor on any road, park or reserve within the boundaries of the metropolitan area or of a town or townsite, whether on foot or in a vehicle. Minimum Penalty: $200, Maximum Penalty: $1000+
    30.   Passenger Property Loss:
    All property and valuables remain the responsibility of their owners. Drivers are not permitted under strict company policy to store, look after passengers’ goods or clothing or hold the property for Safe Keeping. Nightcruiser or their Representative cannot take responsibility for items left on vehicles and or are lost or stolen.
    If any property is found deemed lost, we hold it at the Depot after entering it into a Lost Register.
    We will not be liable or will not pay for damage to property or clothing which belongs to any person in vehicles including trailers.
    We take no responsibility for the lost property while waiting for collection.
    30a. Electronic devices disclaimer [iPhone, iPods and other devices]:
    Nightcruiser and its Sub-Contractors encourages the use of Electronic Devices, Laptops, Tablet PCs, iPhone, iPad, iPod and Smartphones for the purpose to allow passengers to bring their own music.
    Nightcruiser or its Sub-Contractors cannot accept any responsibility for such electronic devices if damaged, lost whilst on the vehicles or damaged electronically.
    At no stage must they be left unattended with the Sub-Contractor Driver, Chauffeur or Nightcruiser Captains at any time.
    All Charterers must advise their guests of this fact and agree to do so. Any connection leads required should be brought along by Charterers.
    31.  Soiled and or damaged Clothing:
    We have a regular routine cleaning program in place; however, we ask you and your guests to check seats prior to use as we will not accept responsibility for any soiled, damaged or torn clothing resulting from seats, the interior or exterior of the vehicles.32.   Photo IDs:
    Are imperative for all patrons entering licensed premises. It’s their responsibility to have them available. Some venues now require 2 ID’s.33.   Under Age:
    Persons taking responsibility for these terms and conditions must be of legal age, 18 years and over. If any passengers are found to be underage on alcohol-related tours, they will need to make their own way home at their own expense and can not stay on board with the Nightcruiser during the duration of the organised total schedule.34.   Conduct Code is Simple:
    “Nightcruiser” and its Representatives operates under its own strict Code of Conduct and any fighting, rioting, vandalism, unruly and abusive behaviour/language in or outside vehicles, in public or venues, damage to personal property, passengers or property of the Nightcruiser / Vehicle will result in the immediate termination of a tour/charter and withdrawal of services. Nightcruiser Party Bus Tours are foundation members of various Accords and strictly abides by these codes.
    Nightcruiser is a foundation member of the Nightclub Tours Operators of Australia, Gold member of the Party Bus Association of Australia and their code of conduct.

    35.   Vehicle Damage:
    Where the vehicle is damaged by you or your guests or left in an unpleasant condition (e.g. Vomit), the vehicle may be withdrawn immediately, and if deemed necessary, all bond may be kept. If you or your guests cause excessive damage, Nightcruiser and or its Representatives will take action to recover all costs incurred. Vomit will incur an automatic $50 disinfection charge and or loss of Bond.

    36.   The breaking of Emergency Windows:
    Back Window, Roof Emergency Exit vents, Middle or Front doors without an emergency will incur an automatic replacement cost, plus new signage charge. Total approx. $550.00 depending on the damage.36a. Transport regulations:
    Replacement only by licensed tradesmen.37.   Fire Extinguisher and First Aid Kits:
    If abused by passengers they will need to be replaced and charged to the Client.

    38.   Venue Dress Standards and behaviour rules:
    It is the individuals’ responsibility to make sure they adhere to venues dress codes and behaviour rules.

    39.   Musical Requests:
    Clients are welcome to bring their own CDs and iPhones, iPods or other devices to play their own music at their own risk. Suitable connection cords should also be supplied.

    40.   Power Sound System:
    Amplifiers and Speakers are checked prior to departure from our depot, should they fail during the tour you agree not to make any claim against us. We will endeavour the repair or replace during your tour but feel the continuation of tour/transport is paramount.

    41.  Weather:
    Weather Conditions can not be used as a reason to cancel Nightcruiser services

    42.  Payments:
    Bond payments must be received in advance before we confirm your booking.  Payments for the Job must be made upon arrival in cash prior to service allowing you to collect from your guests.
    All payments can be made in advance via:
    1. Visa or MasterCard (No Amex) (over the phone 0427 553340).
    2. Pay anybody Bank Transfer.
    3. Direct over-the-counter bank deposit or
    “Last minute” guests are more than welcome and the Crew will provide you with the different payment options.
    Electronic transfers carry no charge and must reach us by the due date.
    Payments made by Credit Card incur a small additional 1.9%- 2.9% Surcharge as to what we are charged.

    43.  Price change and Money due:
    You can not change the price agreed to prior to the arrival of the service. If you experience fewer passengers turning up it is your responsibility to make up the difference or increase the per head basis you collect. The bond can at times be used towards payment if authorised by the Operations Manager of Representative, but will not be refunded or cannot be claimed at a later time.

    44.Covid-19
    It is the responsibility of the Hirer to ensure all government laws, signage displayed, requests by the Driver or Company and all procedures related to Covid-19 are adhered to. The Driver and Company reserve the right to refuse entry or terminate a charter if any passengers are exhibiting symptoms associated with COVID-19 and will not be liable for any costs associated with this.

    We will require a passenger manifest with each passenger’s full name and contact number prior to your departure in writing.

    When we have transported a passenger who becomes infected with Covid-19, the Hirer is responsible for notifying the Company immediately.

    The above Terms and Conditions still apply, however, our cancellation policy will differ due to COVID-19 related matters.

    45. COVID POLICY
    Nightcruiser Party Buses and our Sub-Contractors [Suppliers] endeavour to follow the safety guidelines as set by the AU Government for the various COVID-19 Levels.

    • If the region where the event is booked is in lockdown level 3 or 4 and we (Nightcruiser Party Buses and the supplier) cannot provide the event as planned due to the level restrictions, where possible, the event will be postponed to a future date agreeable with all parties. This way we are protecting all the businesses involved and the work that everyone has put into planning your event to date.
    • Where an event cannot be rescheduled, we will offer a full refund of your bond where our Sub-Contactor [Supplier’s] COVID policy allows but your deposit is non-refundable as stated at the interim in your booking email. Due to the time of the year, a very small number of our suppliers only offer postponement of events and packages booked. In this instance, Nightcruiser Party Buses will indicate in the proposal text under those packages and suppliers affected.
    • If the region where the event is booked is in level 1 or 2 – the event can go ahead, and it will go ahead as originally planned. Please refer to our normal cancelation rules. No refunds are given should the number of guests has dropped due to some choosing not to attend due to COVID or their region being in lockdown. Where possible, we can look at postponing your event, however as stated in your booking email your deposit is lost if canceling.

      Postponement Terms
    • Pending the Sub-Cotractor [Supplier’s]  postponement terms which are normally either 3 or 6  months from the booked event date, we will reschedule your event for a date that will suit both you and the affected Sub-Contractor [Supplier].
    • Please note that if funds have been forwarded to the Sub-Contractor [Supplier] already in terms of a bond or deposit or final payment and for any reason, in the postponement time frame the supplier goes into receivership, Nightcruiser Party Buses is not liable and those funds can’t be claimed back through Nightcruiser Party Buses. For your event to go ahead, Nightcruiser Party Buses would have to book another Sub-Contractor [Supplier] and a new Booking email with costs would be issued.
    • We are happy to postpone the event wherever possible however it could occur an admin fee. This will apply each time you change the date.

    46. LIMITED LIABILITY Nightcruiser [Agent]
    46.1 If a liquidator, trustee, receiver, administrator, administrative receiver or similar officer is appointed over the Sub-Contactor [Supplier] and if your [Buyer] deposits, bonds, job fees have been forwarded to the Sub-Contactor [Supplier] you agree not to claim any monies paid to us. They need to be claimed from the Sub-Contractor [Supplier].
    46.2 You [Buyer] agree not to claim any damages against us, caused out of the consequence of the Sub-Contractor’s actions, not providing the services or refunding any funds, agreed not to claim again us [Agent]
    46.2 You agree not to claim any damages that might have been caused due to any loss of the Sub-Contractor’s action.

    47. FORCE MAJEURE
    47.1 The Agent reserves the right to defer the date of delivery or to terminate the Relevant Obligations or alter the Services ordered by the Buyer (without liability to the Buyer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of the Agent including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, provided that, if the event in question continues for a continuous period in excess of 80 Business Days, the Buyer shall be entitled to give notice in writing to the Agent to terminate the Relevant Obligations.

    48. CANCELLATIONS DUE TO GOVERNMENT-MANDATED SHUTDOWN
    In the event of a cancellation due to a government-mandated shutdown, you can change the date of your tour (provided it’s within 12 months) with the
    following condition: Money that we have paid to venues to secure your booking and tasting MAY OR MAY NOT BE RECOVERABLE. This will depend on the venues’ policies and it is beyond our control.
    We also cannot guarantee that the venue will be able to accommodate you at a later date.
    We do NOT offer refunds in the event of a government-mandated shutdown.

    49. ADDITIONAL  CHARGES
    We reserve the right to apply additional charges due to suddenly increased fuel costs and extra if your agreed schedule does overtime as stated in your tentative or confirmed booking email.

    TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 1

    Bond [various] payable to secure the vehicle for use with your booking.

    Vehicle and booking will not be secured for your tour until the bond is received, and therefore first come first served due to the demand for Nightcruiser Party Bus Tours.

    The bond is refundable on a separate occasion, providing there is no damage on or to the bus reported.

    Bond is not refundable if the Terms and Conditions below are not adhered to:

    ADDITIONAL TERMS & CONDITIONS – Sub-Contractor No. 1 

    Your bond is not refundable if any of the below terms are breached:

    1. There is to be ‘NO’ Glass/Bottles whatsoever on and/or around the Bus.
    2. There is to be ‘NO’ stand on and/or jump on the seats.
    3. Any damage, mess and/or vomit on the bus. (Bins are provided for rubbish)
    4. Smoking is not permitted on the bus.
    5. Violence, violent behaviour and/or sexual abuse towards staff and/or other passengers, will not be tolerated and we reserve the RIGHTS to terminate your tour at any time if this occurs.
    6. We, The Sub-Contractor accept no responsibility for passengers being refused entry into a licensed premise due to Intoxication or any other reason and/or any other anti-social behaviour in and/or outside the bus or any premises.
    7. The organiser of the tour is financially liable for any damage to the bus and must keep their Guests under control.
    8. If you are not at the pickup point at the time provided you will forfeit your travel (No refund will be given).
    9. If you cancel your booking your bond is not refundable.
    10. While, we, The Sub-Contractor always take every precaution and care for the safety of our passengers , we are not liable for any passenger who injures themselves on, and/or outside of the bus.

    Update:

    From the 1st of March 2021.
    All bookings for a bus will require a bond payment in order to secure your booking. The full payment must be paid 21 days in advance before the date of your event.

    Without payment of the deposit, there is no guarantee that your booking is confirmed and if the full payment has not been received 21 days before your event, then there will be no refund for your bond and the bus will be cancelled.

    We are unable to refund any deposit/bond paid if you cancel at anytime nor accept any claim if the agreed schedule has been changed by you during our service, therefore make sure before confirming your booking before you pay the bond.

    TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 2

    Term & Conditions of Hire

    Missing or Damaged Equipment or fittings to the vehicle:
    If there is any deliberate or malicious damage done to the vehicle, then the repair will be quoted at a cost with an additional administration fee charged by the Sub-Contractor

    Repairs to Vehicle:

    Any repairs that are required will be appropriately quoted by a qualified repairer, Which will be determined by the Sub-Contactor’s company.
    The Hirer/ee whose credit card is used for the booking will have that Credit Card charged for any damages or other chargeable offences (no shows, outstanding balances, cancellations to name a few)

    Cleaning Fee:

    Any additional cleaning fees (such as vomiting) will be charged at a flat rate of $350 or as determined by the driver or the Sub-Contractor at the time (This includes carpet steam clean and wash down inside vehicle. Australian Licensing act. Extra time will also be charged at minimum $350 per hour but this can vary depending on time of the day/night and at the discretion of driver or the Sub-Contractor with prior arrangements.

    Payment Details:

    A credit card must be on file at the time of booking before finalized booking can commence. The full amount or remaining balance is due on the day of hire, or prior to hire, unless pre-arranged with management. If PayPal or Square is used as a method of payment for invoices or any other payment – the Sub-Contractor will pass their fees over to the payee unless otherwise stated.

    The Responsibility of the Hirer:

    The hirer accepts that him or her and their entire party comes aboard at their own risk and “The Sub-Contractor” and its affiliates accepts absolutely no responsibility and/or liability of any person/s wellbeing and physical state whilst on board, and the hirer or  his/her delegate must agree to do everything in his/her power to help minimise likelihood of accidents occurring such as keeping patrons seated to prevent slipping/falling or other such accidents/incidents. The Sub-Contractor will take all reasonable care to make sure its patrons arrive safe at their destination.

    The hirer shall be solely and fully liable and responsible for the behaviour and wellbeing of all passengers and shall be primarily responsible for any damage caused to the vehicle whatsoever.

    The hirer shall be fully responsible and liable for any damage caused both inside and outside the vehicle by the hirer or a member of his or her party. This includes irrational behaviour resulting in damage to the vehicle or its contents by a third party. The hirer must fully agree to be held liable for the retail cost of any repair as a consequence of any damage caused. The hirer further agrees that the company may at its entire discretion determine the repairer that will fix the damage to the vehicle. In addition, the hirer shall be responsible for payment of a fixed rate, which shall be determined by the company, at its sole discretion for the period during which the vehicle cannot be used as a consequence of said damage and repairs. That notwithstanding, the hirer shall also be responsible for any further losses which are incurred as a result of lost bookings. The hirer holds the company, its agents or employees harmless of any liability for any personal or material damages arising from the conduct of his or her party.

    The company, its agents or employees shall not be held liable or responsible for any articles left in the vehicle and the hirer specifically indemnifies the company, its agents or employees from any such responsibility and undertakes to advise all other persons in his or her party.

    The consumption of food is not permitted in any of the vehicles unless specific agreement has been made to the contrary at the time of the booking and agreed in writing. Where complimentary drinks are supplied by the Sub-Contactor, these must be consumed in the vehicle and may not be removed for any reason whatsoever. In the event that drinks are removed, then the company may at its discretion, recover the replacement cost from the hirer. Where  food is supplied for any reason by the Sub-Contacrtor the company will at all cost insure that the food is fit for consumption, but will under no circumstances be liable for any sickness/injury as a direct result from this supply, it is at a “at your own risk” type of basis.

    Any abuse or misuse of equipment e.g. microphones and remotes will result in use of such items and service being terminated immediately. This includes swearing into microphones, shouting abuse, and or directing abuse from vehicle so it can be heard outside. This and any other behaviour deemed to be inappropriate by the sole discretion of the chauffeur will result in loss of service immediately. This includes refusal of entry into any venues due to intoxication levels or any other reason and the Sub-Contractor, can and will cease service immediately if deemed necessary.

    As stated below, the Sub-Contactor can and will recover any money for loss of property that is provided in the bus/limousine. This includes, but is not limited to; glassware, cushions, bar equipment, DVD’s, CD’s, TV’s, Curtains.

    The hirer accepts the fact that there is to be a no smoking policy in the vehicle at all times. This is in accordance with the Bus Accreditation rules and regulations policy. The company does not permit the consumption of illicit drugs whilst in the vehicle. Failure to comply may result in the termination of hire.

    Irresponsible behaviour that causes damage to the vehicle or endangers the safety of the other passengers will not be condoned. This includes, but is not restricted to; sitting on the exterior of the vehicle, hanging out of the windows, opening the curtains and making rude or inappropriate gestures to the outside public, shouting abuse, rudeness or intolerance with the chauffeur, arguing with the chauffeur, misuse of the equipment, fixtures or consumables in the vehicle and wilful damage to the interior generally. Also, opening of the emergency hatch is forbidden. This is for emergencies only, and fines will apply if not adhered to. Such behaviour may, at the discretion of the chauffeur and the Sub-Contractor, result in the immediate termination of the hire without compensation. In addition, the hirer shall be held liable and responsible for any loss, howsoever caused, by the behaviour of his or her party.

    The hirer accepts that the DVD, CD and all other equipment is provided as a courtesy. In the event that the equipment fitted to the vehicle malfunctions prior to or during the hire, the Sub-Contractor accepts no liability whatsoever and no compensation shall be provided, nor will the company provide a refund. In the event that a vehicle is involved in an accident or suffers from mechanical failure, or is no longer safe to drive, then the company shall make alternative arrangements to get the hirer and his or her party to their destination. The company may at its entire discretion determine the method of onward travel and has the right to cease any onward travel if necessary. The hirer specifically accepts that the hire is based on a best endeavours of the Sub-Contactor, and it will do anything in it’s power to assist where appropriate. There can be no specific guarantees in terms of time, reliability of the vehicle and events out of the direct control of the chauffeur or the company.

    Alcohol may not be consumed by passengers under the age of 18 years. It is the law, and the Sub-Contactor will not allow any underage drinking. The Hirer accepts photos may be taken of his/her event and used for marketing purposes or any other purpose the company see fit and Bus Tour Rhymes carries no liability for any photos released from those events

    On-board Entertainment

    If at any time, male or female entertainment (showgirls, strippers, waiters/es or any other form as listed by us) has been hired to be on board the bus during an event, it is the responsibility of the hirer and his/her party to act appropriately in accordance with their own specific rules of engagement and any inappropriate behaviour will be dealt with by the Chauffeur at the time, the Sub-Contractor takes no responsibility or liability for any injury or action caused to the third party entertainment hired or any other persons on board at the time of hire and by agreeing to these terms and conditions both the hirer and the third party body being hired will totally indemnify the Sub-Contractor or any negligence or malpractices.

    Refund Policy:

    To make a reservation the hirer is required to supply a Credit Card on file, photograph proof of Card may be required for legality reasons – unless there has been a prior arrangement made with management.

    The outstanding monies can be paid on the night and none of the deposits made to make a booking are refundable

    Photo ID will be used to identify the hirer on the night. These Terms and conditions apply to the person/people hiring the vehicle unless otherwise stated.

    ADDITIONAL TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 3

    Charter Hire Terms & Conditions

    To confirm a booking and reserve transport the Sub-Contractor requires the requested non-refundable deposit amount. Once the deposit has been received, they will issue a booking confirmation sheet. At this time customers are subject to the following Bus Hire terms & conditions.

    Amendments

    Any amendments to your booking after confirmation can only be accepted subject to availability. The Company reserves the right to charge an amendment fee for any such events.

    Booking Confirmation Information

    It is the responsibility of the customer to read through all the information on the Booking Confirmation sheet and to check that all the details are correct.

    Cancellations

    In the event of a booking cancellation the Sub-Contractor reserves the right to charge a cancellation fee as follows:

    a. For cancellations made between the booking date and 7 days before the date of travel: 50% of the value of the booking

    b. For cancellations made 7 days or less before the date of travel: 100% of the value of the booking

    Credit Card Charges

    In the event of credit card payments, The Sub-Contractor will charge an additional bank fee of 2% of the value of the booking. The Sub-Contractor regrets that you are unable to take payment via American Express.

    Damage To Vehicle

    If the vehicle is damaged or soiled as a result of passenger actions, a clean-up fee of a minimum of $100 will be payable and/or the full cost of the damage will be charged to the person who made the booking.

    Deposit and Final Payment

    The Sub-Contractor requires a non-refundable deposit of 50% of the value of the booking to confirm a reservation. The balance is payable in full no later than 1 week prior to the date of travel.

    Extensions

    Should your event with the Sub-Contractor not run to schedule, and extra hours are required, the company reserves the right to charge an extension fee, in addition to the cost of the extended charter service.

    Food and Beverage

    Food and beverage cannot be consumed on the company’s vehicle without prior approval. Should you wish to consume food and beverage on a vehicle, a premium will be included in the price to cover professional cleaning costs.

    Seat Belts

    Seat belts are compulsory, and the company has the right to refuse travel if they are not worn.

    Smoking

    Smoking is not permitted on Boomerang Bus Hire transport.

    Student Travel

    The Sub-Contractor requests that students observe the Code of Conduct (for bus travel) at all times.

    Refusal of Travel/Termination of Charter

    The Sub-Contractor has the right to terminate the charter or refuse travel to passengers who are:

    a. displaying unacceptable behaviour

    b. causing damage to the vehicle

    c. overly intoxicated

    Unforeseen Circumstances

    The company will always endeavour to get customers to their destinations on time, however, are not liable for delays subject to unforeseen circumstances, for example heavy road traffic or extreme weather conditions.

    Vehicles Used

    The Company works closely with other high-quality charter services. From time to time the vehicle provided will be that of another company. Should this be the case with your booking please rest assured that all the vehicles we use meet our high safety and respectability standards

    TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 4

    General rules are applicable as public passenger transport.

    Above all, the driver has right to terminate the Charter at any time.
    This includes (but is not limited to) the occurrence of emergency events, war or terrorist activities, riot, civil unrest, strike, lock out, stoppage or restraint of labour, weather conditions, fire, flood, drought, road conditions, closures, unforeseen alterations to public transport schedules, epidemic or outbreak of illness or on the happening of any event over which the Sub-Contractor has no control (including but not limited to mechanical failure) or should you be in breach of your Responsibilities or if we are unable to agree on a change to the Charter.
    On such termination, our responsibility for your Charter ceases immediately and we shall not be liable for any extra costs incurred by you.
    Full refund with 24 hours notice, 50% refund within 5 to 24 hours notice, no refund for less than 5 hours notice.
    COVID
    The above Terms and Conditions still apply, however, our cancellation policy will differ due to COVID-19 related matters.

    TERMS AND CONDITIONS FOR Limousine & Hummer Sub-Contractor No.5
    • Min 1 Hour hire.
    • Excludes Weddings, public holidays, special events and after-hours.
    • All bookings to be fully Pre-Paid prior to the transfer date.

    INCREASED RATES APPLY TO SPECIAL EVENTS AND PUBLIC HOLIDAYS
    Free 5 minute grace applies for all clients, however, after 5 minutes charges will apply every 15-minute intervals.
    CANCELLATIONS WILL FORFEIT ALL DEPOSITS, CANCELLATIONS WITHIN 45 DAYS WILL INCUR 100%.
    100% Surcharge Applies for all NO SHOW Bookings.

    TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 6

    Cancellation Policy

    Any self-cancellations prior to 72 Hours of Travel Date or, by enforcement of lockdowns from State or Federal Authorities due to COVID will entitle you to move the date or a full refund.   Any cancellations (other than the latter COVID related) within 72 – 24 Hours of Travel Date incur a 10% charge of the full booked amount + $20.00 Admin Fee.  Bookings cancelled within 24 Hours of the trip –  No refund but an alternative date can be arranged.

    TERMS AND CONDITIONS FOR SUB-CONTRACTOR NO. 7

    Term & Conditions of Hire

    The hiring of Sub-Contractor: Missing or Damaged Equipment or fittings to the vehicle: If there is any deliberate or malicious damage done to the vehicle, then the repair will be quoted at a cost with an additional administration fee charged by the Sub-Contractor.

    Repairs to Vehicle:

    Any repairs that are required will be appropriately quoted by a qualified repairer, Which will be determined by the company. The Hirer/ee whose credit card is used for the booking will have that Credit Card charged for any damages or other chargeable offences (no shows, outstanding balances, cancellations to name a few)

    Cleaning Fee:
    Any additional cleaning fees due to inappropriate or irrational behaviour will be charged to the credit card used for booking. (This includes Seats/walls and wash down inside vehicle.)

    Payment Details:
    A credit card must be on file at the time of booking before finalised booking can commence. The full amount or remaining balance is due on the day of hire, or prior to hire unless pre-arranged with management. All details will be shown in your tentative booking email from Nightcruiser.

    The Responsibility of the Hirer:

    TERMS & CONDITIONS

    Your bond is not refundable if any of the below terms are breached:
    1. There is to be ‘NO’ Glass/Bottle whatsoever on and/or around the Bus.
    2. There is ‘NO’ Stand on and/or Jump on The seats.
    3. Any damage, mess and/or vomit on the bus. (Bins are provided for rubbish)
    4. Smoking is not permitted on the bus.
    5. Violence, violent behaviour and/or sexual abuse towards our staff and/or other passengers, will not be tolerated
    and we reserve the RIGHTS to terminate this Booking and/or this Agreement at any time if this occurs.
    6. We, The Bus Rental accept no responsibility for passengers being refused entry into a licensed premise due to Intoxication
    and/or any other anti-social behaviour in and/or outside, any premises.
    7. The Organiser and/or The Renter of the booking is financially liable for any damage to the Bus.
    8. If you are not at the pickup point at the time provided you will forfeit your Booking (No refund will be given).
    9. If you cancel your booking your deposit is not refundable.
    10. While, we, The Bus Rental, take every precaution and care for the safety of passengers at all times,
    we are not liable for any passenger who injures themselves on, and/or outside of the bus.

    TERMS & CONDITIONS – Sub-Contractor No. 9

    Terms & Conditions

    The Sub-Contractor wants to ensure you have a great experience when you travel with us, therefore please take the time to read the following terms and conditions.

    Quotations

    All rates quoted, but not limited to, over the ‘phone, email, advertised on this website or other social media, unless explicitly stated, refer to “general transfers”, between the hours 7am and 10pm, excluding but not limited to Public Holidays or major events. Quotes are valid for 7 days and subject to availability.  A quote does not necessarily reflect availability.  A verbal quote without written confirmation is not valid after the conclusion of that verbal communication.  Please accept a formal quotation as evidence of the quotation, available via email.

    Alcohol

    The person booking the vehicle takes full responsibility, that all alcohol brought and consumed in the hired vehicle, is done so by persons over 18 years of age.

    Food

    Food must not be consumed in the vehicle at any time.

    Smoking

    Smoking and use of any form of illegal substance is not permitted in the vehicle.

    Seat Belts

    The vehicle has seat belts fitted for each passenger. Under current legislation, it is required that each passenger travelling in the vehicle, apply and fit the provided seat belt during travel, unless otherwise authorised.

    Passenger Misconduct

    The driver (chauffeur or operator) at the time of hire, may, at his own discretion, terminate the vehicle hire or eject any person(s) that are, in the driver’s opinion, acting inappropriately and/or dangerously during the hire period. Our Driver will not provide any refund for a terminated hire.

    Financial Liability

    The client assumes full financial liability for any damage to the vehicles caused during the duration of the rental by them or any members of their party.

    At the company’s discretion, the client agrees to be fully liable for all charges that may incur but are not limited to:

    Stretch Rides

    $25.00 per broken glassware
    $300.00 minimum for each carpet or seat burn
    $1,000.00 Sanitation fee (due to sickness interior)
    $200.00 Detailing and wax (due to sickness exterior)
    $500.00 minimum for each act of vandalism

    Party Minibus / Van
    $300.00 minimum for each carpet or seat burn
    $500.00 Sanitation fee (due to sickness interior)
    $200.00 Detailing and wax (due to sickness exterior)
    $500.00 minimum for each act of vandalism

    Damage to Vehicle and Equipment and Missing Inclusions

    You are responsible for any deliberate or malicious damage caused to the vehicle or equipment by any passenger during the hire period. Any damage to the vehicle will be quoted at cost plus administration fees and will be deducted from your credit card you have supplied us at time of booking or paid on presentation of invoice. Missing or broken glasses during the hire period will attract a charge of $25.00 per glass (Champagne Flutes and Tumblers).

    Cleaning Fees & Bond

    A cash Bond of up to $500 will need to be sighted to the Driver on arrival as this will allow driver to be comfortable that if damage or cleaning is needed to be applied driver knows that this fee can be honoured.  Cleaning fees due to inappropriate behaviour, illness and miss use of the vehicle during the hire period, will forfeit the bond and addtional charges will be applied as per cleaning rates stated above (includes, carpet steam clean and wash down inside of vehicle). Payment can also be deducted by way of PayId.

    Payment

    Bookings are confirmed when full payment or a deposit of 50% via Master Card of Visa Card is successfully processed.  Direct Deposits can be accepted for Deposits as well and the balance of payment due, payable no less than seven (7) days from booking. Weddings and School Formals require full payment no less than ten (10) days prior to booking date.

    Credit Card Charges

    Payment by Credit or Debit Card will attract a surcharge as follows: no more than 2.5% [Check your Nc booking email]

    Wait Time/Overtime

    Whilst we will accommodate passengers during their travel, additional time required by you will be charged in 15 minute increments after the booked finish time. Additional time charges may include, but are not limited to, delayed airport arrivals and pickups, weddings that go over the scheduled finish time and general or corporate hire delays caused by you. Waiting time/Overtime is charged at

    $150 per 15 minute increments for the Ford F250 Stretch SUV

    $50.00 for the Custom Hiace Minibus,

    $200 per 15 minute increments for XL Hummers,

    12 Seater Mercedes Sprinter Party Bus charged at $100.00 per 15 min and must be paid to the driver in cash at the end of your travel with us.

    The Sub-Contractor, at all times, will endeavour to ensure you arrive at your destination, safely, comfortably and on time. However, we can not be held liable for any event which is beyond our control, including but not limited to, traffic delays, weather, illness or vehicle breakdown. In such circumstances, you must allow The Sub-Contractor to do all things possible to resolve the problem and complete your hire (e.g. if vehicle breaks down, provide a replacement subject to availability). As part of or Terms and Conditions, The Sub-Contractor reserves the right to employ sub-contract vehicles and drivers to complete your hire if and where available.

    Our Driver Event Transfers will not be obligated to refund any monies unless we are unable to resolve the situation.

    All deposits and payments are non-transferable. Also at various times the colour of vehicle chosen may not be achievable.

    Insurance:

    Our Insurance Policy covers all authorised persons travelling in the vehicle on route to your destination. Unless chauffeur assisted, passengers assume personal liability when entering and exiting vehicle.

    Luggage Capacity

    The client is responsible to ensure the luggage carried will fit in the requested vehicle type.  In the event the luggage is in excess of the vehicle capacity, any further costs incurred to transport the excess luggage is at the client’s cost.

    Baby Seats and Booster Seats

    Baby Seats and Booster Seats are not required in a Sedan/Stretch in the same way they are not required in other forms of public transport such as buses and taxis at the passenger’s discretion.  In the event you do require a Baby Seat or Booster Seat, they can be supplied at an additional fee of $25 each per transfer.

    Deposits and Cancellations*

    A 50% deposit is required on bookings outside of an 8 week timeframe via credit card, debitcard, PayID or EFT (Electronic Funds Transfer) are required to confirm a booking. In the event the booking is cancelled, this must be communicated via email to and use the email on your booking email and Booking Crew member.

    Corporate Functions, Weddings, School Formals and General Hire – Payment and Cancellation Requirements

    A 50% deposit is required on bookings outside of an 8 week timeframe for each vehicle hired, with your booking being confirmed when deposit is paid. Credit Card, Direct Debit is accepted as confirmation to secure your booking. The balance of the hire fee is due and payable 7 days prior to the date booked for your event. If you request cancellation of your booking, the deposit will be forfeited or if balance was paid in full a minimum of $150 Booking cancellation fee or whatever the company deems fair will be applied to cover cost and losses incurred by the company. You must notify us in writing by email or by SMS should you wish to cancel your booking. All deposits and payments are non-transferable without authorisation from the Sub-Contractor.     Wedding Hire – Additional Cancellation and Schedule Requirements

    Cancellation must be received 30 days prior to the booked wedding date in writing. You must advise us of the cancellation by Email or SMS. The deposit will be forfeited to cover cost and losses incurred by the company. If cancellation is received within 21 days of the booked wedding date, a $500 cancellation fee will be payable in full or deposits and payments are forfeited and could be subject to non-transferable with out authorisation from the Sub-Contractor.     Once you have confirmed and agreed your booking sheet outlining your Schedule for the day, any required changes must be notified to us in writing 30 days prior to the booked wedding date. In the event that we are notified of any changes within 30 days of the booked wedding date, we reserve the right to refuse any such changes due to previous bookings scheduled.

    Limo Specials, Deals & Discounts

    The advertised specials on this website or other media are available for the specified times and dates which are advertised.  These specials are only available for “General Transfers” between the hours 6am and midnight, excluding but not limited to Public Holidays or major events.  Payment will only be accepted in full by Visa or Mastercard.  A merchant fee of no more than 2.5% is applicable.  The advertised availability may change without notice.

    Please also note:
    The chauffeur has the right to terminate the run without refund (if there is blatant indiscretion on the part of the client(s) or if client(s) do not follow chauffeurs request to obey the rules of this agreement
    Drug use is prohibited by law
    Smoking is prohibited in all limousines and food is not permitted.
    The Sub-Contractor will not be responsible for articles left in the limousine.
    The Suib-Contractor cannot guarantee the availability of overtime
    Outstanding balances are to be paid to the driver on the run date before the beginning of the run.
    Vehicles cannot be loaded beyond seating capacity

    Power-operated Equipment

    Since the Sub-Contractor offers high-tech-equipped vehicles, sometimes heat and excessive use of all power-operated equipment might be subject to temporary failure. This will of course not interfere with the safety of the vehicle itself and therefore will have no effect on continuing or paying of the contracted trip. The Sub-Contractor guarantees, that all our vehicles are constantly checked to keep the highest possible standards and eliminate such failures as much as possible.

    Mechanical Breakdown and Other Unforeseen Events

    The Sub-Contractor agrees to send the requested vehicle as offered in the contract. We have the right to upgrade the vehicles or switch the vehicles in case of emergency breakdown, unforeseen circumstances or if vehicles were in accidents. As stated, this will only happen in emergencies, and to upgrade, never downgrade. If no upgrade is available, the Sub-Contractor gives the client the right to downsize the vehicle and receive discounts. No additional charges will occur on the client’s side if an upgrade is made without the request of the client.

    If changing of limousines occurs in the same category, or upgrades are made, it will not affect the contract and / or payment of contract. Client’s therefore accept that replacement limousine may be substituted if contracted limousine becomes unavailable for any reason.

    If any of our above guarantees or contracted terms cannot be met due to conditions outside of our control, including weather, accidents and any other acts of god, including, but not limited to traffic congestion, road closures, accidents, flight delays, weather delays, road closures etc., we will use our best efforts to notify the client of these conditions and resulting delays or changes.

    The Sub-Contractor is not liable in the event of mechanical breakdown while on charter or any other unforeseen circumstances causing delay or cancellation and will only be responsible for making up lost time at a mutually agreed date.  Any refund or reimbursement for a delay or cancellation of a transfer will be at the discretion of the Sub-Contractor.

    Privacy Policy

    All Personal information collected by Nightcruiser and the Sub-Contractor is treated in the strictest confidence and will not be disclosed in full or in part to anyone other than Nightcruiser or The Sub-Contractor booking and billing bureau. The technology adapted for Nightcruiser & The Sub-Contractor’s use, is constantly maintained in order to protect all information collected.

    At any time, you may request to view your personal information collected and recorded by Our Driver Event Transfers.

    Confidentiality Agreement

    When ticking the terms and conditions, you agree to keep confidential any and all information provided to you by Nightcruiser & The Sub-Contractor as it is considered to be industry sensitive. This includes all information regarding services provided and prices quoted.

    Important Note:

    Due to the length of the stretch limousines, access to some suburban streets and venues may be restricted and pickup and drop offs at front door may not be possible.

    CHANGE NOTICE: As with any of our administrative and legal notice pages, the contents of this page can and will change over time. Accordingly, this page could read differently as of your very next visit. These changes are necessitated, and carried out by the Sub-Contractor in order to protect you and our website.     • Wedding & Formal Bookings – The Booking Fee is 50% of the Total account for all vehicles, with a minimum of $100 being required..(50% of the original deposit amount is non refundable)
    • All Wedding vehicles are supplied with white ribbons and wedding decorations from our range. With the exception of coaches unless organised at the time of booking.
    • The vehicle/s supplied will be the vehicle/s stated except in circumstances beyond our control.
    • Whilst we will do our upmost to get you to your chosen destination on time, we take no responsibility for delays incurred that are out of our direct control, ie: bad traffic conditions or mechanical breakdown. In the event of any unforeseen circumstances, be it a mechanical breakdown, or any other event, either before or during the booking, Premier Limousines will provide a substitute vehicle if possible or other mode of transportation. We reserve the right to substitute a vehicle in case of an emergency. No recompense will be given in these circumstances should they occur.
    • No responsibility will be accepted for restrictions relating to vehicle access at any location
    • Any compensation will be in kind
    • Once a Wedding Booking is confirmed and Booking Fee has been paid, we reserve the right to charge a minimum administration fee of $25 for each major change ie: car & dates. You will not be charged for minor updates like times etc.
    • Clients are reminded that is against the law to partake of non prescribed drugs, alcohol or cigarettes while in a passenger carrying vehicle. Alcohol may be permitted in a Stretch Limousine.
    • In the event of any soiling or damage to the vehicle caused by the client or passengers, the client will be responsible to meet the costs of repairing and/or cleaning the vehicle – $250 for cars & smaller buses, $360 for larger coaches
    • You are advised we do not allow the consumption of alcohol or food on board our coaches or sedan limousines and some classic and vintage cars. We ask that you advise your group of this requirement.

    All care taken with Luggage & personal effects, but no responsibility taken for damages caused in transit. Please ensure that you have travel insurance

    All prices are subject to change without notice, however once a booking is confirmed by the acceptance of a Booking Fee, the agreed price at the time of receipt of the Booking Fee will not be affected by seasonal price rises.

    10 minutes after scheduled pickup time waiting time will be charged at $1.20 per minute for Sedans and Mini Buses and $2.40 for Stretched Limousines. Larger coaches from $1.80 up to $2.50 per minute

    Airport Pick Ups: Domestic Flights Waiting time will apply 25 minutes after touchdown of the scheduled flight arrival time.

    International Flights, Waiting time will apply 60 minutes after touchdown of the flight. In the case of lost luggage where the driver is asked to wait, wait time will be charged at $1.20 per minute for Sedans and Mini Buses and $2.40 for Stretched Limousines.

    Additional airport parking tolls will also apply.

    CANCELLATIONS

    Mini & Touring Coach Charters – Stretch Limousines

    In the event of a cancellation we treat each booking individually. Special consideration may be given when the circumstances are beyond the control of the client.

    • Cancellation more than 7 days prior to the booked charter date:

    Full refund of any monies paid less a $44 administration fee

    • Cancellation within 7 days and 24 hours prior to the booked charter date:

    Loss of 25% of the total charter price.

    If a replacement booking of equal or greater value is accepted and paid for, for the vehicle, by a new client, then a full refund applies less an administration fee of $44.

    • Cancellation within 24 hours prior to the booked charter date:

    As above with a loss of 50% of the total charter price

    • Cancellation on the day of the charter, or any other cancellation of charter, or failure to arrive for charter

    Full payment retained

    • Cancellation over 60- 180 days prior to the booked date:

    Loss of 25% of the total charter price for the booking unless a replacement booking for the vehicle/s is accepted and paid for. In such an event an administration fee equal to 10% of the charter value, with a minimum amount of $55/booked vehicle, is retained

    • Cancellation over 60 days prior to the booked wedding or Formal date:

    • Cancellation over 90 days prior to the booked wedding or Formal date:

    These terms & conditions will still apply during national or world crisis events, though we will do our best to work with the client should this occur.

    If a wedding is postponed & payment has been made the above terms & conditions only apply to the original booking date. Eg: if you postpone a fully paid wedding booking to another date or the next year, the cancellation policy relates to the original booking date only.

    TERMS AND CONDITIONS OF HIRE

    Upon Securing your booking with a deposit/bond [check your Nightcruiser booking email] and or hiring our services, you are agreeing to these terms and conditions.

    DEPOSIT/BOND

    20 seat/ 19 seat/ 14 seat deposit/ bond $300To Confirm and Secure your booking a deposit/ bond amount within 24HRS. – If you can’t please let us know as your booking will not be confirmed. [All details in your Nightcruiser Booking Email]
    We are flexible with this if you inform us.
    Once paid please send through remittance/reference/ proof of payment.
    BOOKINGS ARE NOT SECURE UNLESS DEPOSIT IS RECEIVED
    The deposit/bond is separate to the bus hire payment and will be returned if after an inspection of the bus at the final drop off location,
    providing our Terms & Conditions are met
    PLEASE NOTE: If you have paid in full via bank transfer or credit card, please send through your bank details for your bond to be returned the week after the event providing our terms and conditions are met upon inspection of the bus.
    Our drivers do not carry cash if you have paid via this method.
    All Deposits are non-refundable if you cancel for any reason.
    CANCELLATIONS:
    All deposits/bonds are non-refundable if the charter is cancelled for any reason.
    If you cancel the service upon arrival of charter Full charter cost is due and payable.
    If you cancel within 24 hours of the charter date – the full amount quoted is due immediately.
    If you cancel within 7 days of charter 50% of total charter cost is due immediately.
    If you cancel with more than 7 days’ notice – deposit/bond is non-refundable FOR ANY REASON.
    All deposits (if cancelled) can be reused on another booking within 6 months of original date,
    please note that a one-time transfer of date only after one date change bond is withheld.
    PAYMENTS:
    The Sub-Contractor bookings can be paid for in a number of options, we accept: Cash, Credit Card or Bank transfer as valid payment methods. [Check your Nightcruiser Tentative Booking Email]
    FOR ALL 20/ 19/ 14 seat Sub-Contractor bookings:
    Where you are paying in cash for the charter – please ensure you have the full amount quoted collected and ready to give to the driver at the start of the charter.
    Please understand the drivers do not carry change so have the corrected amount quoted.
    All Invoices must be finalized before the hire commences.
    The driver will only accept the full amount quoted and will not take individual payments from customers.
    Bank transfer – if you choose to pay Via Transfer, the full quoted cost must be transferred 1 week prior to the date.
    If this method is chosen bond will be transferred back electronically providing all T&C’s are met
    Credit Card – if you choose to make full payment via CC this must be done 1-week prior [Check Nightcruiser Booking email]
    Again, bonds will be transferred back electronically if paid via this method.
    Full amount quoted due 1 week prior to booking date either via credit card or bank transfer.INTOXICATION:
    If a passenger/s are found to be overly intoxicated and or causing issues to the public – they may be asked by the driver or a the Sub-Contactor representative to leave the bus and to source their own transport at their own cost.BUS BEHAVIOUR:
    The Sub-Contactor likes to ensure that  staff and drivers are able to enjoy a safe and fun environment without being subjected to rude, aggressive or dangerous behaviour from the client / his or her guest whilst in charter.
    The driver has his/her legal right and duty to request a passenger/s to exit the vehicles under on of the following occasions:
    Smoking/ Vaping on board
    Passenger/s are rude/aggressive and or abusive
    Passenger/s are and or have damaged party equipment or the Sub-Contractor’s Property.
    Passenger/s Dancing on seats or climbing dance poles.
    Any Physical fighting, unruly or abusive behaviour, damage to personal property, passengers’ property or property of the Sub-Contractor will result in Termination of charter and withdrawal of services.DAMAGES BOND:
    Every Sub-Contractor charter requires a bond. Your deposit paid to secure your booking becomes your bond on the day of charter. [Full details in your Nightcruiser Booking email]
    If all terms and conditions are adhered to, the bond is refundable in full after the event in a method determined by your payment option.
    Your bond will be withheld/termination of charter in full if;

    Vomit if found on any part of the vehicle this includes exterior
    Bus is left in an unsatisfactory way – bottles, cans, rubbish etc
    Damage to any part of the interior – The Sub-Contractor with take action to recover costs if required
    Standing on seats/ shelves/ fittings
    Excessive mess on floor
    Damage to party equipment eg – lights/stereos etc
    Emergency exits/hammers activated
    Smoking/ Vaping
    Unpleasant conditions – urine etc
    Driver excessively distracted by passengers
    Please understand that if any damages are caused to any public/private property by patrons on charter, The Sub-Contractor is within its rights to pass on details of the Hirer as you are responsible for your group.
    The Sub-Contractor will not be held responsible for any costs or liability for any damages all liability remains with the hirer.
    The Sub-Contractor accepts no liability for the actions of any other patron or member of the public for any loss or damage to any property or for injury or death caused to any patron.
    The Hirer and the driver will inspect the bus after the charter is completed, if the bus is in good condition/clean and or no terms have been broken bond will be returned – you must sign the envelope provided by the driver.
    If terms are broken the driver is within his/her rights to withhold the bond.
    Our vehicles are inspected before, during and after the trip has ended. All financial liabilities of repairs or replacements will be the sole responsibility of the customer.

    STANDING/DANCING:
    Please understand that if you stand, you do so at your own risk.
    It is recommended that whilst the vehicle is in motion that all passengers are seated
    It is recommended where seat belts are provided that passengers should use them.
    Please understand that if you suffer any type of injury while on our vehicles, The Sub-Contractor will not be held responsible.
    All buses are equipped with first aid kits and a driver willing to help if required.

    CAMERAS/CCTV:
    All vehicles are equipped with video and recording devices. The footage recorded will and can be used in a court of law and footage will solely remain the property of The Sub-Contractor.

    CLIENT RESPONSIBILITY:
    The Hirer is solely responsible and liable for the actions and behaviours of all their passengers/s. if the Hirer is unwilling to control issue passengers/s the driver has the legal right and duty to ask passenger/s to exit the vehicle immediately and the tour/charter to continue without them. Failure to comply will result in termination of carter and no refund will be provided and or any expenses incurred by the passengers will not be reimbursed by The Sub-Contractor under any circumstances. By booking this service it is the clients responsibility to ensure all guests are aware of the terms and conditions.
    The hirer will be asked to enforce these conditions upon the day of charter and if not being adhered to loss of bond and or termination of charter.

    Please note: The hirer must nominate a responsible lead guest to count the number of passengers at each stop getting on and off the bus.
    It is the lead guest and hirers responsibility to ensure that everyone in the group is accounted for and on the bus at each stop.

    DEPARTURE TIME/OVER TIME/DESTINATION CHANGES:
    All of The Sub-Contractor’s buses are booked for set time slots. If passenger’s fail to board within 15 minutes of the agreed time the bus will depart.
    $50 per 15 min and $50 per half an hour after may be applied also.
    If passenger’s fail to board while on tour the Client /lead guest will need to make the final decision upon if the bus departs within a max time frame of up to 15mins.
    After this point the driver will need to depart and The Sub-Contractor will not be held responsible for passenger’s failing to load and depart at agreed time and it will be the passenger/s responsibility to source transportation at their own cost.
    If a wine tour/pub crawl/transfer runs over time by more than 20 minutes The Sub-Contractor is within rights to withhold $150 on all party buses.
    Please understand if you wish to change your drop off location from what originally was booked in you must do so 1 week prior to the booked event.
    Please understand that on the day of charter if drop off location is changed; additional charges may apply.

    BUS REQUESTS:
    If you have requested a specific type of bus, we will try our best to provide this bus but unfortunately circumstances may arise that will prevent this from happening. In this case we will provide another similar bus.
    All our buses have similar features and service.
    If you have booked a 20-seater bus and numbers drop and you wish to request a smaller bus – if one is available we are happy to swap otherwise the full amount quoted for the agreed bus size will be due and payable
    The Sub-Contractor reserves the right to allocate its buses to suit conditions. In some cases, 20 seater buses may complete 19 seater jobs at no extra cost and
    The Sub-Contractor vehicles may be used as well for no extra cost.

    PUB CRAWLS:
    Please note: after you have paid your deposit your next thing you will need to do is choose the venues you and your group wish to attend.
    Please note there are some venues we cannot drop directly out front of due to either traffic or council regulation, in this case the driver will drop you at the next closest spot.
    Please ensure all passengers carry ID and are over the age of 18 as well as dressed to each venue’s dress code.
    The Sub-Contractor will not take responsibility or provide any refund for patrons refused entry for any reason (over intoxicated/antisocial behavior/any other reason deem by the venue)
    The Sub-Contractor will refuse to continue the Pub Crawl with these particular passenger/s
    The Sub-Contractor accepts no liability for the actions of any other patron or member of the public for any loss or damage to any property or for injury or death caused to any patron.

    PUB CRAWLS:
    The Sub-Contractor is governed by local government laws and guidelines on all set down and pick up locations for pubs and clubs, please understand you may not be dropped in front of specific locations due to this.
    The Sub-Contractor makes these bookings with agreed venues on our list on your behalf.
    Any venues not on our list are required to be booked in by the hirer prior to the tour.

    WINE TOURS:
    Please note: after you have paid your deposit your next thing you will need to do is contact the venues you and your group wish to attend.
    Once you have confirmed your venues and times please send your itinerary through to us so we can add to your booking.
    Full payment will be required if the tour is cancelled due to failure to book venues.
    Please understand that you as the hirer are responsible for your guests throughout the day.
    If a group is refused entry to a venue The Sub-Contractor is within its rights to Terminate charter and return to initial pick up with no refunds and full monies paid.
    Any fights/ anti-social behaviour on The Sub-Contractor Buses are not tolerated and the charter will be terminated.
    If a venue askes the group to leave, the hirer must ensure all the group departs the venue asap.
    Any damage/theft at any venues will be the responsibility of the hirer to provide information regarding if such incident arises
    The Sub-Contractor is within its rights to pass on details of groups in question relating to any incidents and will not be held liable for any damages or theft caused by groups while on charter.

    BREAK DOWNS/DELAYS:
    The Sub-Contractor gives its advice on journey times in good faith and does not guarantee the completion of any journey in any specific time and will not be liable for loss or inconvenience
    caused by the actual journey time (should any issues arise on route with passenger/s) Traffic, road works, previous group delays,
    unpleasant conditions clean up, festival traffic and acts of nature are all points of which
    may cause delay to planned pick up/drop off time.
    Drivers will do their best to inform clients of any possible delays. The Sub-Contractor will not be held Liable for any refunds or discounts due to any of the stated points.
    The Sub-Contractor reserves the right to change vehicles subject to breakdown or unforeseen circumstances.
    Should alternate vehicles be used in such circumstances, no refunds will be given.
    Any compensation will be assessed on a case by case basis

    SCHOOL FORMALS:
    The Sub-Contractor charges School Formals on a Per person basis with a minimum number/cost stated in the quote – this process is non-negotiable. [Check your Nightcruiser Booking email]
    1.5hrs allowed prior to the ball drop time and depending on after ball 1hr allowed on pick up.
    A max of 10 minutes is allowed for the clothes change stop – no exceptions
    If after Formal location is further than 15 mins from initial pick up location extra charges will apply
    No bags or belongings to be brought on/left on bus/coach – please arrange for bags to be transported elsewhere by a parent etc.
    All School Formal booking cancellations require 7 days’ notice or full charter cost is due and payable.
    Once your final numbers are confirmed (7 days prior to ball) the balance price is final.
    If any changes happen to your numbers please ensure this is before 7 days prior to the event as individual refunds are not available.
    Full payments to be received 1 week prior to school ball – no exceptions

    PASSENGERS PROPERTY AND LOST PROPERTY:
    Pull Up VIP takes no responsibility for loss or damage of personal items on board during or after your event.
    All personal Belongings eg jackets, bags, phones are the responsibility of the hirer.
    We ask that all personal items are removed on every start and completion of the journey.

    Quotation Terms & Conditions

    Your booking is accepted subject to the following terms and conditions and by confirming your booking you accept these terms and conditions will apply.

    Quotation

    Prices are based on current rates and are GST Inclusive. All quotes provided by The Sub-Contractor are subject to change when bookings are confirmed and variations occur to the original quotation.  The Sub-Contractor quotes are valid for 28 days and may vary after this time to cover additional operation costs.

    Amendments

    When a booking has been confirmed, any amendments to this booking may incur additional charges and fees.

    Extensions to the Booking on the day

    Any variations to the journey on the day of booking may incur additional charges and fees.

    Cancellations

    In the event you need to cancel your booking with The Sub-Contractor, the following cancellation fees may apply. Please also check your Nightcruiser Tentative Booking email.:

    • 48 hours or more, prior to transfer – No Charge
    • 24 – 48 hours, prior to transfer- 25% of booking cost up to $110
    • 6 – 24 hours prior to transfer – 50% of full booking cost
    • Less than 6 hours prior to transfer – 100% of full booking cost

      Bus Policies

      • Seat Belts must be worn in the buses that have them fitted.  (All our buses are fitted with restraints for your safety)
      • NO SMOKING is permitted on any of our buses. (It is against the law in Queensland to smoke in a Public Transport Vehicle)
      • Food and Drink are not to be consumed on the vehicle without previous approval. Alcohol is not permitted
      • All passengers must remain seated whilst the vehicle is in transit.
      • Passengers are not permitted to place any part of their body outside the vehicle whilst the vehicle is moving.
      • The Sub-Contractor reserves the right to terminate a charter of any actions are deemed threatening or dangerous to the driver and or other passengers.

      The driver is authorized to have an unruly passenger removed, who are threatening or placing the driver and or passengers in a dangerous situation.  The removal of a passenger will not occur if it places that passenger at any risk, but may be reported to the Police if deemed necessary by the Driver or The Sub-Contractor Management.​

      Damage to Vehicle

      ​If there is any damage or unreasonable damage or soiling caused to the vehicle as a direct result of your booking, The Sub-Contractor will be entitled to seek full restitution for all costs to repair and clean the vehicle.

      Lost Property

      All Lost Property will be returned to the Sub-Contractor’s office and registered in our Lost & Found Register.   Lost Property can be collected from their office between the hours of 8:00am and 4:00pm Monday – Friday.

      Messages from The Sub-Contractor

      The Sub-Contractor reserves the right to outsource Chartered Bus work when it is unable to undertake a booking due to vehicle availability.  This will not result in an increase of the agreed quote provided, unless the vehicle type varies and is specifically requested by the client.

      Finally, all Passengers travelling with The Sub-Contactor are encouraged to enjoy their journey, We want your outing to be fun.

    TERMS & CONDITIONS – Sub-Contractor No.12 Limos

    Special conditions apply for all package deals. Preference for a particular Hummer colour can’t be guaranteed, minimum numbers apply and exclusive hire of the hummer isn’t always provided.  Packages are not available with any discounts, vouchers or any other offer.

    PAYMENT, REFUND & CANCELATION

    • A minimum booking of 1 hour applies to bookings unless agreed otherwise by Management.
    • A 20% deposit (of the total booking amount) [as per your Nightcruiser tenteative email booking] is payable to secure and confirm a booking. No bookings will be held without the payment of this deposit.
    • The final balance is due 1 month prior to the day of hire.
    • If a booking is made within 1 month of the hire day, full payment is required at the time of booking.
    • If a booking is cancelled more than 1 month out from the day of hire, a cancellation fee of $100 applies. The balance of funds already paid are refundable.
    • If a cancellation is made within 1 month of the booking, the deposit is non-refundable.
    • If a cancellation is made within 2 weeks of the booking, no money is refundable.
    • Credit card transactions attract the following fees: 2% Visa and MasterCard, 3% Amex and Diners
    • In the event that a booking runs overtime, beyond the agreed booking time, additional charges will apply. For this reason, all bookings require credit card details to be provided as security. This credit card will be charged in the event of bookings running overtime.

    BEHAVIOUR IN THE LIMO DURING HIRE

    • If the inside of the vehicle is left in a dirty/soiled manner, then a cleaning fee of $300 will be charged to the hirer.
    • Smoking or the consumption of drugs is not permitted in the vehicle at any time. Failure to comply may result in the immediate termination of hire without any refund.
    • Irresponsible, dangerous or intoxicated behaviour will not be accepted and may result in the immediate termination of hire, without any refund.
    • Only handbags/small carry bags are permitted to be carried in the vehicle. If luggage is to be transported, this must be indicated on the booking form to allow the appropriate arrangements to be made.

    DAMAGES TO THE LIMOS

    • The hirer will be held responsible and liable for any damage to the vehicle, (inside or outside including equipment and fittings), caused by themselves or a member of their group. The cost of repair for such damages will be the responsibility of the person hiring the vehicle.
    • If glasses are broken or lost, the hirer will be responsible for the cost of replacement (at $15 per glass).
    • If equipment provided in the vehicle (including bar utensils, CD’s, DVD’s, LCD TV’s, remote controls) is either lost or damaged, the hirer will be responsible for the cost of repair/replacement.
    • If there is damage to the vehicle which results in the vehicle being unavailable for future hire, then the hirer of the vehicle at the time the damage occurred will be held liable for losses resulting from lost or cancelled bookings, whilst the vehicle is repaired.
    • As security to cover for potential breakages, damages or losses, credit card details must be provided at the time of booking. This credit card will be charged to cover costs for repairs, replacements or losses.

    In the event a hummer is involved in an incident and is unable to complete a booking, the Sub-Contractor whenever possible will provide an alternate hummer. Whilst every effort is made to complete a booking as requested, events & occurrences outside the control of the drivers and the Sub-Contract do occur which may result in interruptions, delays or cancellations and no specific guarantees can be made. Any compensation will be at the absolute discretion of the Sub-Contractor.

    TERMS & CONDITIONS – Sub-Contractor No.13 Limos

    Payment Reference:
    A 20% deposit is required to secure your booking. The remaining balance is due 30 days before the date of service unless agreed
    otherwise.
    Cancellation Policy:
    In the event that you need to cancel your trip, the following options are available:
    – Cancellations made up to 14 days before departure: You will receive a full credit of the amount paid. This credit is valid for one year
    from the cancellation date for future bookings.
    – Cancellations made less than 14 days prior to the date of service: You will be credited 50% of the amount paid. This credit is also
    valid for one year from the cancellation date for future bookings.
    Please be informed that these credits can be applied to any of our services and are valid for a year from their issuance.

    Terms and Conditions Sub-Contractor No.14 Limo Buses

    1. Offensive, aggressive or disorderly behaviour to the driver, staff members or guests on board will not be tolerated and will result in termination of the service.

    2. Appropriate conduct will be outlined by staff members upon arrival

    3. Alcohol will not be sold on the bus

    4. Under-age drinking is not permitted on the bus

    5. Smoking is not permitted on board

    6. We reserve the right to refuse entry if any person(s) is heavily intoxicated or under the influence of drugs

    7. We reserve the right to remove any person(s) who is heavily intoxicated or under the influence of drugs to a taxi at your own expense

    8. Illicit Drugs are not permitted on the bus

    9. Weapons or sharp objects will not be permitted on board

    10. We are not responsible for loss or damage of personal items

    11. We are not responsible for injury incurred due to careless or inappropriate behaviour

    12. Violence will not be tolerated. Removal from the bus will occur immediately and police will be called. The service will terminate from this point. No exceptions.

    13. The bus is fitted with CCTV surveillance cameras for insurance and legal purposes. We reserve the right to view the footage should damage or injury occur.

    14. Damage, missing equipment or fittings will be quoted and charged for replacement/ repair as a result of malicious or deliberate behaviour

    15. A minimum will be charged for seat damage and taken from the bond. An additional invoice will be provided if the replacement cost is greater than this amount

    16. A $300 fee will be applied and taken from the bond for a person(s) vomiting, urinating or defecating.

    17. A $200 fee for cleaning will be applied for removal of chewing gum or excessive drink spillage.

    18. We are not liable for unforeseen traffic/street access conditions if arrival is delayed.

    19. The pickup location must be suitable for our 9m metre bus to gain access.

    20. Additional guests will not be permitted once the service has commenced

    21. Entry to venues is at the discretion of venue staff, based on normal entry requirements.

    22. A non-refundable deposit required at the time of booking

    23. The full amount is to be paid 1 week prior to the event if paying in bank Transfer

    24. Less than seven days’ notice cancellation 50% of the total cost will be charged

    25. Less than 48hrs notice cancellation full amount will be charged

    26. Rescheduling may occur if more than 14 days’ notice is provided depending on availability within 12 months

    27. $300 BOND will be held to a credit card and refunded 24hrs after the event if no damage or misplacements have occurred.

    28. Photos and videos will be published on our website and social media after the event. You must advise us if you do not wish this to occur prior, during or by the following week of the event.

    29. In the event that the bus breaks down 80% will be refunded or the option of rescheduling will be available.
